How the Calculation Works

The damages calculator works out a commercial loss scenario from the receipts and costs you enter. Net scenario loss equals expected receipts minus actual receipts minus costs avoided, plus incremental expenses, minus mitigation contribution.

Expected receipts are the receipts assumed without the alleged event. Actual receipts cover the same activity and assessment period. The receipts gap is lost revenue before adjusting costs. Costs avoided reduce that gap because those costs were not incurred.

Extra expense adds costs incurred because of the alleged event. Mitigation contribution reduces the loss by the net benefit of replacement work or another response. Enter that benefit after deducting the costs of earning it. Exclude it from actual receipts so the same benefit is deducted once.

Use one currency and a consistent tax basis. The calculation applies no interest, discounting or tax adjustment. It assumes you have already aligned the assessment period and removed overlapping amounts.

Legal recoverability, causation, remoteness and apportionment require separate professional judgments. The High Court’s Clark v Macourt judgment explains contractual compensation and mitigation. The applicable legal measure can differ from this receipts-and-costs scenario.

Compare Two Supported Scenarios

The fictional base scenario uses expected revenue of $200,000, actual receipts of $0, avoided costs of $100,000, extra expense of $10,000 and mitigation contribution of $30,000. The result is $80,000.

The alternative includes a disputed additional expense of $15,000. Changing extra expense to $25,000 produces $95,000, an increase of $15,000. Both sets of inputs remain editable and appear together in the reconciliation.

Open Alternative scenario to change a disputed input. Record the reason in Disputed items and identify the supporting document in Source references. Each scenario has its own assumptions and source notes, which the export keeps beside its figures.

Use Economic Loss: Liability and Financial Evidence to consider how the records support the scenario. The broader expectation damages analysis addresses the contractual measure separately.

Read and Export the Loss Schedule

A positive result is a loss under the entered assumptions. A negative result is a scenario gain and stays negative. Zero means the components balance. These results do not establish an award or extinguish a claim.

Zero is a valid input, including when no actual receipts or mitigation contribution applies. A blank or invalid amount makes the results unavailable until corrected. Enter positive component amounts with up to two decimal places. The formula applies their addition or deduction.

Gross replacement receipts can overstate mitigation when earning them requires extra costs. Enter their net contribution and keep its workings in the source notes. Avoided costs must also be incremental to the lost activity, rather than unchanged overheads.

Download loss schedule CSV retains both labels, every signed formula component and the net results. It also includes assumptions, source references and disputed items for expert review. Displayed estimates use whole dollars. The export retains cents as plain numbers.

All entries and calculations stay in this browser tab. The calculator does not save the schedule between visits. Export before closing the tab, then keep the file with the documents supporting your assumptions.
