Expert Witness Withdrawal From a Financial Matter

When a financial expert cannot continue, check expert witness withdrawal against the appointment, court directions, existing reports and preserved work.

Expert witness withdrawal requires separate decisions about ending the instruction and resolving any existing court obligations. A financial expert’s notice of unavailability does not, by itself, settle the status of a delivered report or a scheduled conference. The expert and responsible solicitor must establish the role, identify the affected work and use the applicable procedural route.

Identify What is Ending and Why

Record the proposed change precisely. Ending a private engagement, seeking release from a court-appointed role and changing an opinion are different actions. A party’s attempt to remove an expert raises a further issue and needs its own procedural assessment.

State the practical reason without obscuring its effect on the work. Illness might prevent attendance at a conference while leaving a completed report unchanged. A newly identified conflict requires assessment of its effect on independence. An inability to finish one calculation might affect only part of the instruction.

Disagreement with the instructing party does not justify suppressing an independent conclusion. The Federal Court’s Expert Evidence Practice Note places the expert’s impartial assistance to the Court above the retaining party’s interests. A proposed departure must be handled consistently with that duty.

Keep a contemporaneous record of the reason, when it became known and what the expert can still do. Record sensitive personal details only to the extent needed for the engagement or procedural decision.

Check the Appointment and Existing Directions

Read the accepted instruction and the orders together. Identify the court and proceeding, who appointed the expert and whether the role is party-appointed, jointly instructed or court-appointed.

Make a working schedule of the obligations that departure could affect:

  • Delivered reports and any outstanding supplementary work.
  • Questions requiring an answer and the deadline for each response.
  • An ordered expert conference or joint report.
  • A hearing, attendance requirement or subpoena.
  • Agreed record-transfer arrangements and restrictions on disclosure.

For a Federal Court matter, Part 23 of the Federal Court Rules distinguishes Court experts from parties’ experts. Rule 23.02 requires a Court expert’s report within the Court’s fixed time. Rule 23.15 permits orders about conferences and how expert evidence is given. Assess those obligations against the actual orders before proposing a change.

For a family-law matter, Part 7.1 of the Family Law Rules contains the single-expert framework. Rule 7.19 allows a single expert to request a procedural order before final orders. The request must state the order sought and reasons, comply with the communication rule and be served on each party.

These provisions do not establish a universal requirement to obtain leave before ending every private instruction. The responsible solicitor must identify whether this appointment requires a variation, permission or further directions. Record the proposed route and who will take it. The single expert report procedure also affects replacement arrangements.

Inspect any accepted notice and termination terms, including applicable APES 305 engagement requirements. Contractual notice and a procedural order answer different questions. One cannot be assumed to resolve the other.

Communicate the Proposed Change Through the Proper Route

Give the responsible solicitor a written account of the proposed departure and immediate availability. Identify the affected deadline or attendance obligation and the earliest point at which a decision is needed. State which work is complete and what remains unfinished.

For a joint instruction, use the authorised communication arrangements. Family Law Rule 7.03 restricts unilateral party communication with a single expert and requires simultaneous communication to the other engaging parties, subject to permitted exceptions. A private discussion with one party must not become an alternative route for changing the expert’s substantive position.

The solicitor can then identify the procedural step needed for the role. Depending on the orders, that could involve notifying the parties, proposing revised dates or seeking directions about release and replacement. Keep a request distinct from the order or agreement that confirms the outcome.

Where a deadline is imminent, identify it explicitly in the communication. If the expert cannot perform the task, say so promptly and accurately. Silence leaves the court and parties without the information needed to address the obligation.

Incorrect record: “Withdrawal notice sent, so the ordered conference is cancelled.”

Correct record: “The expert has reported unavailability. The solicitor is seeking directions about the conference, and its procedural status remains unresolved.”

Preserve Reports, Calculations and Source Material

Departure does not itself retract a report, erase an opinion or determine whether the evidence can be used. Keep the delivered version identifiable and preserve the record needed to explain it.

Retain relevant drafts, instructions and communications alongside calculations and source references. Identify which version was delivered, to whom it was sent and whether it has been filed or otherwise disclosed. Apply the actual retention obligations, production requirements and any preservation hold. Do not invent a single retention period for every matter.

APES 215 Forensic Accounting Services requires applicable members to document the work and the basis and method of calculations. It also recognises that working papers may be required as evidence and addresses custody records for relevant material. These responsibilities support a usable financial work record when an expert leaves.

For example, preserve a transaction schedule with its source statements, allocation method and calculation version. Keep an unresolved classification labelled as unresolved. A successor needs to distinguish a bank-record fact from the departing expert’s assumption or inference.

Where FinTrace supplies the statement-analysis inputs, its searchable ledger and findings report provide direct references to the source PDFs. Retain those inputs with the expert’s own calculations so the financial reasoning remains traceable.

A material opinion change needs separate attention. The Federal Court’s expert code requires a supplementary report promptly after a material change in opinion. Family Law Rule 7.18 requires written notice of an opinion change to the specified recipients and treats it as part of the report.

APES 215 also addresses evidence based on false or misleading information or material omissions. The member must promptly inform the appropriate recipient and consider a supplementary report. Ending the engagement does not substitute for addressing that problem. The financial expert witness report process governs how the changed analysis is explained.

Confirm the Remaining Work and Handover Position

Close the departure record only when it distinguishes confirmed arrangements from outstanding procedural questions. Name the person responsible for each unresolved task.

Consider this fictional Federal Court matter. A party-appointed financial expert has delivered a report and becomes medically unavailable two weeks before an ordered expert conference. The expert tells the instructing solicitor that attendance and further analysis are presently impossible. The report’s conclusions have not changed.

The solicitor requests revised directions. Until the Court determines that request, the record shows an unresolved conference obligation. It must not say that the expert has been released merely because the request was filed.

Suppose the Court then vacates the conference and sets a timetable for replacement evidence. Record that order and its effect on each scheduled task. Separately confirm when the private instruction ends and who holds the preserved work.

Use a completion record covering the following points:

  1. Record the effective departure arrangement and the order or agreement supporting it.
  2. List directions that remain in force, with the person responsible for addressing each one.
  3. Identify every delivered report and any outstanding correction or opinion-change notice.
  4. Record the transferred material, recipient and authority for the transfer, with retained copies and access restrictions.
  5. Allocate unanswered questions, unfinished analysis and the next procedural step.

A successor must identify their own instruction, examine the available material and form their own opinion. A handover does not permit them to sign the departing expert’s conclusion as their own. In a family-law single-expert matter, Rule 7.08 also restricts using another expert’s evidence on the same issue without permission.

The expert witness code of conduct remains relevant while those arrangements are resolved. Before closing the file, compare the completion record with the latest orders and confirm that every outstanding obligation has an identified status and responsible person.
