Insolvency Litigation Support: Proving Recoveries

Build asset recovery claims from incomplete books. Insolvency litigation support reconstructs payments and prepares source-linked records for a liquidator.

Insolvency litigation support reconstructs transaction records and identifies potentially recoverable payments, giving liquidators and trustees the evidence for recovery claims and examinations. When the director hands over no books, bank statements show where money went and which payments need a closer investigation.

FinTrace saves hours of statement conversion and review by turning PDF bundles into a searchable Excel ledger and a clear findings report. Suspicious transactions are flagged with their source PDF filename and page, so your team has the supporting evidence beside the analysis.

What Insolvency Litigation Support Delivers

A reconstructed transaction ledger shows the payments to investigate across the supplied accounts. Payment schedules put the amounts and source evidence together for deciding which claims justify their cost. A claim schedule groups payments by recipient and legal issue, while the underlying statements support the amounts alleged.

Scope insolvency disputes around the disputed payment, the proposed defendant and the legal claim your lawyers intend to pursue. Independent reconstruction establishes the transaction history. Your lawyers assess liability and represent the liquidator, while the court determines contested claims. A trace alone promises no repayment.

For a funding decision, compare the evidence with the likely recovery and the defendant’s ability to pay. Include the legal and investigation budget. A large transfer to a related company might warrant further work, but the commercial decision also depends on available assets and enforcement prospects.

Commercial litigation funding pays agreed costs of pursuing a claim in return for an agreed share of recoveries. A litigation funding agreement sets the funded work and budget, the funder’s return and how recoveries are distributed. It also allocates decisions about settlement and termination. ASIC’s funding guidance addresses settlement procedures and the priority of clients’ instructions. Adverse costs protection needs its own terms, including any cap or exclusions and the arrangement for security for costs.

Section 477(2B) generally requires approval for agreements whose term or performance can extend beyond three months. Approval can come from the court, committee of inspection or creditors by resolution. The Corporations Act’s funding-agreement rule applies even when performance could finish within three months.

Rebuilding Records When Books Are Missing

Bank statements rebuild cash movements when the company’s accounting records are absent. Categorise receipts and creditor payments separately from transfers between company accounts. Group director drawings by recipient, then compare the reconstructed payments with invoices and other available records.

Section 286’s records duty requires financial records that explain transactions and financial position and allow true and fair financial statements. Records must be retained for seven years. Under s 588E(4), a proved failure can create a rebuttable insolvency presumption for the affected period in recovery proceedings.

That presumption has statutory limits. Minor or technical failures do not trigger the failure-to-keep-records limb. Section 588E(7) restricts its use for unfair preferences involving unrelated creditors. A missing handover alone does not establish the records breach.

In a hypothetical reconstruction, two years of statements show regular customer receipts followed by repeated payments to one related entity. Separating internal transfers prevents the same money being counted twice as income. The related-entity schedule then supplies the payment amounts and references for investigating what the company received in return.

FinTrace handles thousands of PDFs through staged extraction and consolidation, including scanned statements supplied in mixed order. Advanced AI workflows combine source-grounding checks with independent reviews to preserve transaction facts. Forensic accountants can use the ledger directly and spend more time interpreting the company’s position.

Evidence for Voidable Transaction Claims

Bank records identify creditor payments and related-party transfers for assessment under ss 588FA to 588FF of the Corporations Act 2001. The provisions cover unfair preferences and other transaction categories, including uncommercial transactions and unreasonable director-related transactions. Section 588FE determines when transactions are voidable, and s 588FF provides court remedies.

Fix the relation-back day before filtering payments. Different claim categories have different look-back periods and conditions. A payment’s size or proximity to liquidation is a lead for investigation, while recoverability depends on the applicable legal elements.

For each payment, keep the account holder and recipient beside the amount and transaction description. Add the transaction date and its position in the relevant period. Cite the statement filename and page, with the corresponding receipt where supplied records show both sides of a transfer.

A hypothetical company statement shows $18,000 paid to a director’s related entity six weeks before the relation-back day. The schedule records that payment and its statement page. The next factual question is what goods, services or other consideration the company received for it.

Estimating the Dividend Effect

A liquidation dividend estimate tests what a recovery would leave for ordinary unsecured creditors. Enter realisations available to the estate after secured claims, then deduct liquidation costs and priority claims. Divide the remainder by admitted ordinary unsecured claims, capping the estimate at 100 cents in the dollar. ASIC’s liquidation guide explains the distribution order.

In a hypothetical estimate, entered realisations of $240,000 less $60,000 of costs and $30,000 of priority claims leave $150,000. Against $500,000 of admitted ordinary claims, the estimated dividend is 30 cents in the dollar. If a disputed recovery adds $80,000 and requires $20,000 of extra costs, that scenario leaves $210,000, or 42 cents.

Keep the disputed recovery outside the base case until it is realised. The scenario shows the potential gain against its extra cost, while the claim evidence and enforcement prospects determine whether to pursue it.

Insolvent Trading and Director Loan Accounts

Statement analysis dates cash-flow warning signs for an insolvent-trading investigation and reconstructs money moving between the company and its directors. Section 588G concerns debts incurred while insolvent, or causing insolvency, where reasonable grounds for suspicion exist. Compensation recovery is addressed by s 588M.

Build the chronology around failed payments, recurring overdrafts and creditor demands. Put bank movements alongside debt due dates and available credit. An invoice can establish when a liability arose, while the later bank payment shows when cash left the account.

For the director loan account, distinguish money advanced by the director from repayments and personal expenditure paid by the company. Compare that schedule with the recorded opening balance and any journals. A transfer description saying “loan” needs the agreement and accounting treatment to establish its character.

In a hypothetical matter, a director advances $12,000 and later receives $8,000 from the company. The bank movements establish those two cash entries. Determining the remaining balance also requires the opening account position and any other supported debits or credits.

Preparing for Examinations

A categorised ledger turns unexplained payments into focused questions for examinations under ss 596A and 596B. Those provisions concern mandatory and discretionary examinations about a corporation’s examinable affairs. The payment schedule helps your lawyers identify the transaction and the person who can explain it.

Take a related-entity transfer and identify who authorised it, what it paid for and where the supporting agreement is held. Group recurring payments to the same recipient. That makes it possible to ask about a pattern without losing the individual statement references.

A bankruptcy trustee can use parallel records for Bankruptcy Act 1966 claims involving undervalued transactions under s 120 or transfers to defeat creditors under s 121. The schedule supplies the payment history for applying those separate statutory tests.

Engaging Outside Providers Under the ARITA Code

An outside analysis engagement needs a documented scope, cost basis and assessment of relevant relationships. ARITA’s declaration of independence, relevant relationships and indemnities (DIRRI) records the practitioner’s independence assessment and required disclosures. ARITA’s DIRRI guidance explains the independence declaration.

For this engagement, record the provider’s connections with the company and interested parties, including any connection with your practice. Identify relationships or indemnities that require disclosure in the DIRRI. The wider practitioner framework is covered by APES 330.

The distinction between remuneration and disbursements follows how the work is supplied and charged. A separate external analysis service ordinarily falls within external costs charged at cost. Your team’s work assessing the analysis belongs in remuneration. Avoid charging the same work through both categories.

ASIC’s guide to approving fees says external costs usually do not require prior creditor approval. Its guidance treats internal costs above actual cost differently. Related-provider arrangements also need assessment under s 60-20 of the Insolvency Practice Schedule, which restricts profits or advantages and specifies exceptions.

Record the accounts and periods covered, approximate statement volume and required outputs in the engagement. Keep the quote, agreed budget and invoice together. Creditor information can then explain why the analysis is needed, how the charge is calculated and its effect on administration funds. The Insolvency Practice Rules require information supporting an informed remuneration decision.

FinTrace performs the statement-analysis work at a fraction of the cost of manual review or engaging a forensic accountant for that same task. Each matter receives a quote based on a fixed base fee plus statement pages. To Request a matter assessment, outline the accounts, approximate pages and timeframe. Statements follow assessment and acceptance of the quote.

From Asset Tracing to Asset Recovery

Asset recovery connects a traced payment to a defendant, a legal claim and property or money that can actually be recovered. For each proposed claim, name the person liable and the remedy sought. Keep the payment evidence beside the documents establishing ownership, consideration or the debt alleged.

Australian asset recovery law supplies the cause of action and the route to enforcement. A voidable-transaction claim, director debt or claim to specific property needs evidence matching its own legal requirements. A statement showing a transfer proves a cash movement. It leaves questions about the recipient’s entitlement and the assets available to satisfy a judgment.

Locating a transfer, preserving assets and obtaining repayment are separate steps. A freezing order restrains dealings with assets to protect the court’s process. It does not itself award the property to the liquidator. The Federal Court’s freezing-order guidance explains that protective purpose.

International asset recovery adds the need to obtain foreign records and assess the law where the property is held. An Australian proceeding can require recognition abroad or separate local enforcement advice. The Federal Court’s cross-border insolvency guidance addresses cooperation with foreign courts and representatives.

Before funding the next step, compare the amount realistically recoverable with the investigation, legal and enforcement costs. Record missing evidence and competing ownership claims. Pursue the route whose evidence and likely net return justify the expense, retaining uncertain recoveries as scenarios in the dividend estimate.
