Land Tax Objections: Grounds and Evidence
Before lodging a land tax objection, separate assessment and valuation issues. Find the state authority and assemble records that support your grounds.

A land tax objection challenges a specific error in an assessment or the land value behind it. Separate those grounds before choosing the state authority and submission channel. For lawyers and accountants acting for property owners, estates or insolvency appointments, the first task is to identify which decision needs changing.
A correct valuation can still produce a disputed liability assessment. A successful valuation challenge can change the taxable value without resolving an ownership or exemption dispute.
Identify What the Land Tax Objection Challenges
Read the notice and identify the disputed component before preparing grounds. Record the issuing authority, assessment number, land identifier, tax period and both the issue and receipt details. Preserve the original notice and its delivery record.
Distinguish these issues in the file:
- Liability: why the named taxpayer is assessed under the relevant law.
- Ownership: which person or entity holds the land, in which capacity and at the statutory ownership point.
- Exemption: the provision relied on and the facts supporting eligibility.
- Aggregation: which holdings the authority combines and why the combination is challenged.
- Valuation: the statutory value, valuation basis or property particulars alleged to be wrong.
A recorded-detail correction can resolve an assessment without a formal objection. Revenue NSW directs owners to update changed circumstances or exemption information first. Victoria also permits common corrections and first exemption claims through its administrative channels. Preserve the requested correction and response alongside the notice. Treat an unresolved legal dispute as a separate objection task, with its own deadline.
For a vacant residential land tax objection in Victoria, establish the property’s actual use and the relevant exemption conditions. Build an occupancy chronology from leases, occupation records and other evidence of use. Match the chronology to the assessment period and the exemption relied on. The SRO’s vacant residential land tax instructions distinguish portal corrections, legal objections and capital improved value objections.
If a client asks for a rates objection form, obtain the notice first. A council charge, a valuation used for rates and a state land-tax assessment require different decisions and potentially different forms.
Choose the Assessment or Valuation Route
Send liability grounds to the state revenue authority and valuation grounds through the statutory valuation process for the notice. A council-rates valuation objection concerns the value used in the council’s calculation. A dispute about a council levy or its rate-setting decision belongs with that council’s process.
For example, a client might accept the site value but dispute whether land held as trustee belongs in an individual assessment. That is an assessment issue. If the client accepts the ownership treatment but disputes the land area used in the valuation, identify the valuation route.
Incorrect approach: attach a recent appraisal of the house and ask the revenue authority to remove the tax.
Correct approach: identify whether the dispute concerns liability or statutory value. For a valuation challenge, explain how the evidence relates to the required valuation basis and valuation point.
A private market appraisal does not itself amend the statutory land value. A sale price for an improved property also needs a reasoned connection to a land-only valuation. Where an expert report supports the grounds, keep the relevant valuation reasoning and comparable evidence with the submission. The property valuation report guide covers reviewing that report.
Follow Victoria’s SRO and Valuation Procedures
Use Victoria’s State Revenue Office (SRO) assessment process for legal liability grounds and its valuation portal for disputed statutory values. Keep the two lodgements separately identifiable if the matter raises both.
For an assessment objection, the SRO assessment guidance requires detailed grounds and identifies a 60-day period from service. Late assessment objections require reasons and remain subject to the statutory outer limit. Use GEN-Form-04 for the formal assessment objection. A reassessment objection is confined to new or increased liabilities.
For land tax, the valuation issue concerns site value. Vacant residential land tax uses capital improved value. The land valuation objections portal requires a separate objection for each property. Supply the customer and assessment references, property details, challenged value and supporting grounds. Valid objections go to the valuation authority.
The ordinary valuation period is two months. For the land-tax notice route in section 18(c) of the Valuation of Land Act 1960, it runs from receiving the assessment. The SRO’s dedicated valuation guidance states that the Commissioner cannot accept late land-tax valuation objections. Lodge within time rather than relying on the portal accepting an explanation for delay.
For council-rates valuations, Valuer-General Victoria’s instructions direct the objection to the council issuing the notice. Use its form or the appropriate VGV residential, rural or commercial/industrial pro-forma. Submit the completed form and attachments to the council, which refers a valid objection for valuation review.
Section 18 ordinarily allows two months after service of the valuation notice. It also provides a specific four-month rule for an occupier in the circumstances described in section 18(b)(ii). Establish which provision applies to the actual notice. VGV’s valuation guidelines state that councils have no power to accept an objection outside the statutory period.
Compare the NSW and WA Authorities
In NSW, Revenue NSW determines land-tax assessment objections and the NSW Valuer General determines land-value objections. In WA, the corresponding routes are RevenueWA and Landgate.
The Revenue NSW land-tax objection instructions give a 60-day period from the assessment’s issue date. They cover both the assessment objection and a valuation challenge arising from that assessment. For liability grounds, use the linked online objection form, select Land tax and provide the client ID, reasons and attachments. The same page permits email lodgement and requires reasons for late assessment objections.
Use the NSW Valuer General’s objection instructions for the valuation submission and its limited late-objection policy. Its NSW Valuation and Objection Portal is separate from Revenue NSW’s liability form. For a council-rates valuation dispute, identify the underlying Valuer General notice and its objection deadline. A complaint about a council charge goes to the council.
The RevenueWA objection process allows 60 days after issue of an assessment or notification of a decision. Set out detailed written grounds explaining the alleged incorrect application of legislation. Use its online channel or stated physical lodgement options. A late-extension application must be in writing within 12 months after the objection was due, with full reasons.
For WA valuation grounds, Landgate’s objection instructions specify 60 days from the issue date on the rates or tax notice. Choose the relevant valuation type in its online objection or downloadable form. An extension requires the Valuer-General’s approval and reasonable cause. A higher bill alone does not establish a valuation error: first distinguish changed value from changed charges.
Other jurisdictions have their own authorities and procedures. There is no single Australian land-tax objection form or national deadline.
Prepare Grounds and the Evidence Schedule
Write each ground around the amendment sought, the alleged error and the record that supports it. Identify the affected land and assessment so the authority can connect the argument to its own records.
For ownership grounds, assemble the title history, transfer documents and settlement evidence. A land title search helps establish registered ownership and interests. Keep trust deeds and trustee changes separate from evidence of personal ownership. For an estate, identify the representative’s authority and the documents explaining the ownership position under the relevant state rule.
For an exemption, connect each eligibility condition to evidence of use or occupation. Bank transactions can support payment timing, but a payment alone does not establish occupation or the legal capacity in which land is held.
The following hypothetical index shows how to keep grounds and evidence connected without inventing a valuation.
| Reference | Issue and amendment sought | Supporting record | Connection to the ground |
|---|---|---|---|
| G1 / A1 | Correct the assessed ownership capacity for Lot A | Title history, transfer and trust deed | Explain the capacity at the applicable ownership point |
| G2 / A2 | Apply the claimed exemption for Lot B | Occupancy chronology, lease and supporting use records | Match each claimed condition to the relevant period |
| G3 / A3 | Reconsider the statutory value for Lot C | Property particulars, valuation reasoning and comparable material | Explain the challenged assumption on the statutory valuation basis |
| G4 / A4 | Correct the grouping of identified holdings | Ownership schedule and entity records | Show why each holding belongs in or outside the challenged assessment |
Keep valuation evidence separate from liability evidence. For each comparable, explain the property attributes and valuation period that make it relevant. Identify the basis of any requested value and retain the source calculation. An unexplained figure or a neighbour’s lower bill does not explain why the assessed value is wrong.
Lodge, Verify and Track the Decision
Lodge through the channel for the challenged decision, then verify receipt against the complete submission. Use this sequence for the client file.
- Confirm the client’s authority and your authority to act, including any appointment documents or representative requirements.
- Match every assessment and land identifier to the grounds. Record the deadline, its triggering event and the evidence of service or receipt.
- Finalise the requested amendments and indexed attachments. Remove irrelevant sensitive information from the submission copy while preserving the originals.
- Submit using the selected authority’s official form or instructions. Retain the submitted grounds, attachments and receipt together.
- Check that the receipt identifies the intended matter. If no acknowledgement arrives, verify submission status through that authority before treating the objection as lodged.
- Assign responsibility for further-information requests, the decision and any review deadline. Reconcile an allowed objection with the resulting reassessment and refund or credit.
Payment remains a separate obligation. Victoria’s assessment guidance requires payment on time while an objection is considered. Revenue NSW also requires payment by the due date, including during a valuation objection. RevenueWA states that an objection does not suspend payment.
Landgate likewise requires the billing notice to be paid when due. Seek any payment arrangement through the authority’s separate process.
Keep review routes separate too. Victorian assessment decisions can proceed to the Victorian Civil and Administrative Tribunal (VCAT) or Supreme Court. Valuation decisions have their own VCAT route under section 22. Revenue NSW’s review guidance identifies the NSW Civil and Administrative Tribunal or Supreme Court and a 60-day review period after the determination notice is issued.
For NSW valuation decisions, the Valuer General’s process guide identifies the Land and Environment Court and 60 days from the determination letter. RevenueWA permits a State Administrative Tribunal review within 60 days after notice of its objection decision. Landgate’s valuation route requires a referral request to the Valuer-General within 60 days of receiving the written decision.
Before closing the file, confirm that the decision addresses every ground and that the revised assessment uses the determined outcome. If a ground remains disputed, calculate the review deadline from that decision’s own rules and assign the next action immediately.
