Legal Transcription, Dictation and Court Transcripts
Turn legal audio into a checked transcript. Cover dictation, court transcript requests, speaker accuracy, confidentiality and recorded corrections.

Legal transcription turns recorded speech into a written record that you can check against the audio. Choose the record’s purpose before commissioning it: a verbatim account, an edited dictated document or a summary. For court transcripts, use the relevant court’s ordering process and preserve the official references when quoting evidence.
A readable transcript can still misstate a financial amount or attribute an instruction to the wrong person. Keep the original recording and a correction history so your team can resolve those differences before relying on the passage.
Set the Transcript’s Purpose and Required Accuracy
Specify whether you need the words spoken or a document prepared from those words. A verbatim transcript records speech under an agreed convention for repetitions, interruptions and unclear words. Edited dictation turns a practitioner’s spoken drafting instructions into a letter or other document. A summary selects the substance and leaves out words.
For an evidentiary record, agree how the transcriber will mark overlaps and uncertainty. Editing grammar or removing a hesitation can change how a passage reads. For legal dictation transcription, agree which spoken commands control formatting and which words belong in the final document.
Give the transcriber a written brief with enough detail to identify the deliverable:
- List each source file and the portion to transcribe, including its start and end timestamps.
- Supply known speaker names and roles. Require an unidentified-speaker label when identity cannot be established.
- Set the timestamp interval and require a time reference beside disputed or unclear passages.
- Specify verbatim or edited treatment, with a notation for inaudible words and overlapping speech.
- State the delivery format, version naming and deadline. An editable review copy and a fixed final copy can serve different purposes.
- Agree who checks the transcript, how corrections are requested and how revised versions are distinguished.
Give names and terminology as a reference list. A reference list helps spell a name correctly, but it does not establish which speaker said it or supply missing words.
Record Dictation and Preserve the Source Audio
Capture digital dictation in a quiet setting and identify the matter and speaker at the start. Speak figures distinctly. Say when you are changing an earlier instruction, and distinguish a drafting command from text intended for the document.
For an interview, identify speakers on the recording when practical and ask participants to avoid talking over each other. Make a short sound check before the substantive conversation. Check playback from the device you will actually use, including any remote participant’s audio.
Retain the original file as received or captured. Use a separate working copy for transcription and record any conversion or processing used to reduce noise. Keep access controlled and transfer recordings through the firm’s approved channel. Record the transfer recipient and the source file identifier.
If a working copy reduces background noise, keep its connection to the unaltered recording. Preserving document metadata helps your team explain where the audio and its transcript came from.
In a fictional interview, a draft transcript records a transfer of $80,000. The recording at 00:14:22 says “eighteen thousand”. Replay that passage with the surrounding question and answer before changing the transcript to $18,000. The typed amount alone cannot resolve the discrepancy.
Check Consent, Confidentiality and AI Processing
AI call transcription for a business is lawful only when the recording and subsequent processing meet the applicable rules. The answer depends on the jurisdiction, the setting and how the audio was obtained. A client’s permission to send documents does not establish every participant’s permission to record a conversation.
In NSW, section 7 of the Surveillance Devices Act 2007 restricts recording private conversations, including by a participant, subject to exceptions. The NSW Department of Communities and Justice’s explanation describes consent and lawful-interest exceptions. Do not assume that being on the call permits recording or later disclosure. Check the legislation applicable to the participants and recording method before capture or onward transfer.
Treat permission to record and permission to process externally as separate questions. For a hearing, check the court’s rules and orders. For a client interview or business call, resolve the permitted purpose and explain the proposed recording and transcription arrangements before starting.
The Office of the Australian Information Commissioner’s AI guidance calls for due diligence on intended use, privacy risks and access to personal information. It recommends avoiding personal information, especially sensitive information, in publicly available generative AI tools.
Before confidential audio leaves the matter team, obtain written answers about the proposed service:
- Identify everyone who can access recordings and transcripts, including subcontractors and overseas personnel.
- Establish whether the service uses audio or transcript data for model training or other purposes.
- Document processing and storage locations, with the retention and backup rules.
- Confirm access controls and complete exports. Establish how to arrange deletion when retention obligations permit.
- Name the people responsible for confidentiality incidents and disputed corrections.
Match those terms to your duties of confidentiality, privilege handling and applicable privacy obligations. A confidentiality statement alone does not answer whether the service can reuse audio for training.
Request and Use Court Transcripts
Order an official court transcript through the court’s authorised process. Private transcription of supplied audio creates a separate working record. It does not acquire official status because a transcriber labels it a court transcript.
Start with the court where the hearing occurred. For the Federal Circuit and Family Court of Australia, the recording and transcription guidance allows a party or legal representative to purchase a full or partial transcript. Access to recordings is a separate process. For the Federal Court, the official transcript instructions direct orders through its request form, followed by identity and release checks. The Federal Court prohibits recording a hearing to create your own record of evidence or submissions.
Use this sequence for the relevant jurisdiction:
- Identify the court, registry, proceeding number and hearing details. Name the judicial officer and requested session or extract where known.
- Confirm your eligibility to order and check confidentiality, suppression and access restrictions. Use the non-party process if you are outside the proceeding.
- Follow that court’s current form or portal instructions. Specify the full hearing or selected portion and the required delivery timeframe.
- Confirm charges and any required payment. Retain the order reference with the received transcript.
- Check that the delivery covers the requested session and that its page sequence is complete. Confirm speaker labels before preparing extracts or citations.
Preserve official page and line references. PDF viewer page numbers can differ from the printed transcript pagination. In Victorian civil appeals, the Registrar’s note calls for precise transcript pages in the index and preserves transcript pagination. It also describes useful witness and examination-stage references.
Use the citation requirements for your court and proceeding, including relevant practice notes and directions. If a transcript enters a bundle, court book preparation must preserve the ability to find the quoted passage. Check reproduction and distribution permissions before circulating copies beyond the permitted recipients.
Compare a Transcription Service With Speech Recognition
Choose a supervised transcription service when the job needs a person assigned to resolve difficult audio and manage corrections. Automated speech recognition can prepare a draft from clear dictation. Its usefulness depends on how much checking the recording still needs and whether its processing terms suit the matter.
Choose by the Recording and Review Work
| Decision factor | Supervised service | Automated speech recognition |
|---|---|---|
| Poor audio or overlapping speakers | Specify human listening and how unresolved passages are marked | Expect the reviewer to investigate unclear words and merged turns |
| Speaker separation | Agree labels and how identity disputes are escalated | Check every speaker change that affects the meaning |
| Legal terminology and names | Supply a reference list and require corrections against audio | Check names, citations and words that sound similar |
| Correction handling | Obtain a defined request process and versioned replacement | Assign an internal reviewer and retain the original output |
| Confidential material | Check the service’s actual staff, subcontractor and retention terms | Check processing location, access and model-training terms |
Human review is a specified task, not an implication of the word “service”. Ask who listens to the recording and whether the quotation includes review of the full audio. An automated draft can still require a full listen when the transcript will be relied on as a record of what was said.
After AI output, verify names and figures, then check speaker attribution, omitted speech and negations such as “did not authorise”. Fluent wording does not prove that those words appear in the recording. Keep summaries separate from transcripts so selected points cannot be mistaken for a complete account.
Check the Transcript Against the Preserved Source
Check the transcript by replaying the source and recording corrections against timestamps. Confirm speaker identities before attributing an admission or instruction. Preserve an inaudible or uncertain mark when listening does not resolve the words.
For each disputed passage, listen with enough surrounding audio to understand the question and answer. Compare amounts, account references and names with what is actually audible. A bank statement can identify a possible inconsistency, but it cannot supply words the speaker did not clearly say.
Keep a Traceable Correction Record
The fictional $18,000 correction can be recorded without losing the original draft:
| Record field | Fictional entry |
|---|---|
| Source identifier | Interview-A-original.wav |
| Source passage | 00:14:18 to 00:14:31, amount spoken at 00:14:22 |
| Original transcript | Version 1, page 7, “$80,000” |
| Correction | Version 2, page 7, “$18,000”, checked against “eighteen thousand” |
| Reviewer and reason | Reviewing solicitor, amount misheard in Version 1 |
| Matter-file location | Evidence/Audio/Interview-A and Evidence/Transcripts/Interview-A |
Keep the received version and identify the replacement as corrected. Record the reviewer’s name and review time in the matter file. If the words remain unclear, record the disputed reading separately and leave the uncertainty visible in the transcript.
For an official transcript, submit a correction request through the relevant court or provider’s process. Do not silently overwrite the official copy. For example, Queensland’s transcript request terms require a written correction request and assign required transcript corrections to the provider.
Before quoting or acting on an instruction, confirm that your team is using the identified final version and can retrieve its source passage. Record any resulting instructions in legal file notes with a reference to the checked transcript and recording.
