NACC Act: Records and Notices for Legal Teams

What is the NACC’s role under the NACC Act? Identify the notice, preserve financial records and check the rules for a represented witness.

The NACC Act establishes the National Anti-Corruption Commission and governs its investigation of serious or systemic corrupt conduct involving the Commonwealth public sector. For legal teams receiving a records request, the first task is to identify the statutory instrument and its recipient. That determines the response process, timing and disclosure restrictions.

A financial response needs two connected records: a requirement-by-requirement production index and a transaction chronology tied to original statements. Start with the instrument before asking custodians to collect documents or arranging a witness’s attendance.

What the NACC Act Covers

The National Anti-Corruption Commission Act 2022 (Cth) defines the Commission’s remit and its powers to obtain evidence. NACC stands for National Anti-Corruption Commission. It is the Commonwealth body, with its own statutory process, distinct from state anti-corruption agencies.

Section 8 defines corrupt conduct. It covers conduct affecting the honest or impartial exercise of a public official’s functions, breaches of public trust and abuse of office. Misuse of information acquired as a public official is another category. Conduct by a private person can fall within the definition through its effect on a public official.

For an institutional response, record the relevant person’s role and the public function involved. Identify the alleged conduct and how it connects to that function. Read the definitions of public officials and Commonwealth agencies in sections 10 to 14 alongside the investigation provisions. A supplier’s involvement alone does not settle jurisdiction.

Keep allegations distinct from findings throughout the file. A request for a procurement officer’s payment records establishes that records are sought, not that the officer accepted a benefit. The NACC Act supplies the governing definitions and investigation framework.

Allegation assessment before a compulsory response is a separate task covered in the white-collar crime guide.

Identify the Request Before Collecting Records

Identify whether the document asks for voluntary cooperation or invokes a specific compulsory power. The recipient can be an agency head, an institution or an individual. An employee’s summons does not automatically make the institution the summoned person.

Request or instrumentGoverning basisResponse to organise
Voluntary requestThe request’s terms and the institution’s lawful authority to shareConfirm scope, consent where relevant and applicable disclosure restrictions
Direction to produceSection 57, addressed to a Commonwealth agency headProvide the specified material as soon as practicable
Notice to produceSection 58, served on the specified personFollow the notice’s period and manner of compliance
Hearing summonsSection 63, served on the person required to attendArrange attendance and any specified production at the hearing

Record the instrument’s reference, recipient and service details. Capture every requirement, account or custodian identified, the relevant period and the delivery instructions. Save any attached rights statement and non-disclosure notation with the instrument.

For a section 58 notice, section 59 generally requires at least 14 days after service. A shorter period is permitted where the Commissioner considers that allowing 14 days would significantly prejudice an investigation. Work from the actual notice, rather than assuming every request carries the same deadline.

An application to extend a notice’s compliance period goes to the Commissioner in writing under section 59. Make it before expiry or as soon as possible afterwards, as the section requires. Use the named officer to coordinate the request and retain the decision. Asking for an extension does not itself change the deadline.

Section 63(7) gives the Commissioner power to change a summons’s time or place. The NACC’s witness guidance directs a person unable to comply to contact the specified officer promptly and give reasons. Record the confirmed arrangement before changing attendance plans.

For unclear scope, send the named officer a precise question identifying the affected requirement. For example, ask whether “supplier payments” includes employee reimbursements for purchases from that supplier. Keep collecting the clearly responsive records while the recipient’s lawyer resolves the disputed scope.

Preserve and Index Financial Records

Preserve original records and create a register showing which custodians hold each account’s statements and supporting documents. This is the response team’s working method. The instrument determines what must be provided.

Use the following sequence to keep collection separate from analysis:

  1. Identify each custodian and their authorised access. Record the account holder, account identifier, bank and period covered by the request.
  2. Preserve the files as received. Keep source filenames and page order, with working copies for extraction and annotation.
  3. Log searches and collections. Record who supplied each file, where it came from and any access restriction.
  4. Extract payments into a ledger. Retain the statement description, debit or credit, amount and a reference to the source PDF and page.
  5. Match supporting records. Add invoice, approval or purchase-order references without replacing the underlying statement entry.
  6. Record missing periods and omissions. State whether a record is absent, outside the recipient’s control, unreadable or withheld on an identified legal basis.

The Commission’s compulsory powers do not give an institution a new right to access another person’s private bank account. Identify what the recipient holds or can lawfully obtain. Escalate an access problem to the lawyer coordinating the response, with the affected requirement and search results.

Keep disputed descriptions in a separate analysis field. A statement entry reading “consulting” remains “consulting” even if an investigator suspects a supplier benefit. Record the suspicion, its supporting documents and competing explanations separately. The brief of evidence guide explains how source references support later exhibit organisation.

For a substantial statement bundle, FinTrace saves legal teams and forensic accountants hours of conversion and review at a fraction of the cost of manual review. Advanced AI workflows process thousands of PDFs through structured extraction, source-grounding checks and independent reviews. The service returns a searchable Excel ledger and a written findings report, with suspicious transactions clearly flagged. Findings cite the source PDF filename and page, so the supporting evidence is already at hand.

Check Representation, Privilege and Disclosure Limits

Resolve who the lawyer represents and which NACC rules apply before a witness attends or anyone shares restricted material. Institutional counsel and the employee giving evidence can have different interests. Record the client and assess any conflict before treating the institution’s legal team as the witness’s representative.

Representation at a Hearing

Section 66 allows a person giving evidence to be represented by a legal practitioner. The NACC’s legal-practitioner guidance says the practitioner need not seek leave to appear for that witness. Notify the officer specified in the summons as soon as practicable.

Representation of a person who is not giving evidence has different conditions under section 66(2). Private-hearing attendance also engages section 75. Resolve who can attend instead of assuming the institution’s observer or support person can enter with the witness.

Compulsion and Use of Information

Section 113 removes self-incrimination as an excuse for refusing information or production required by a notice to produce or at a hearing. Its protection against admissibility has exceptions. In particular, it does not apply to production of documents forming records of an existing or past business.

Keep business records separate from compelled answers when advising on information use. Do not promise that every statement, invoice or ledger becomes protected because it was produced compulsorily. Read the remaining statutory exceptions and any applicable disclosure direction before advising on later use.

Section 114 generally removes legal professional privilege as a ground for refusing material required by a direction, notice or hearing. The section preserves exceptions, including advice or communications concerning compliance with a direction or notice, or attendance or reasonably anticipated attendance at a hearing.

Identify which advice falls within that exception. A pre-existing bank statement does not become advice about responding to the NACC merely because it is attached to a lawyer’s email. Keep the underlying record and the advice separately identified. Section 115 addresses material sought from practitioners where the section 114 exceptions apply.

Record a privilege issue for the recipient’s lawyer to resolve against the actual provisions. Avoid applying an ordinary civil-discovery withholding process to every legally privileged communication. Section 114 also addresses secrecy provisions, with an exception for exempt secrecy provisions.

Non-Disclosure and Sharing Records

A section 95 non-disclosure notation concerns a notice or private-hearing summons and related official matters. A section 100 direction controls use or disclosure of investigation material. Record both where they apply, including their exact terms and permitted recipients.

The NACC’s information-sharing guidance explains permitted disclosures, including obtaining legal advice. Those exceptions have defined purposes. Authority to seek advice does not automatically authorise wider circulation to managers, suppliers or an outside analyst.

Before sharing records for analysis, identify the lawful basis and any permission needed. If the proposed disclosure falls outside the applicable exception or permission, seek a decision through the named officer before sending the material. Apply the same check to hearing notes, transcripts and internal summaries.

NSW private-hearing preparation follows a separate regime. Use the compulsory examination guide for that process rather than transferring its rules to a NACC summons.

Verify the Response and Follow-Up

Reconcile each requirement against the final production index before delivery. Each line needs a recorded outcome: produced, withheld on an identified basis, missing or clarified by agreement. Include the source reference and the person responsible for resolving any outstanding item.

In this fictional supplier-payment matter, a notice seeks records of payments to Supplier A over a six-month period. The team finds two payments and an approval record:

EventSource recordWhat the chronology can sayOutstanding point
First supplier paymentAgency statement, page 8, debit $18,000The agency account paid the amount shown against Supplier AMatch the invoice and approval
Second payment, three weeks laterAgency statement, page 12, debit $18,000A second payment carries the same supplier descriptionDetermine whether it pays a separate invoice
Approval located during collectionApproval register, entry 42The register names the approving officerConfirm what the approval covered
One statement period absentCustodian search log, item 7The supplied statements do not cover the full requested periodObtain the record or explain its absence

The investigator’s chronology preserves the payment descriptions and cites each source. A repeated amount raises a question about duplication. It does not establish corruption or tell the investigator why the second payment occurred.

The lawyer’s final check compares the notice with the proposed delivery. Both payments need their source statements, not just spreadsheet rows. The missing period needs an accurate explanation. Any withheld material needs its specific legal basis recorded, and any agreed clarification needs the NACC’s response retained.

Save the exact delivered files and index with evidence of transmission and receipt. For compliance with a notice to produce, section 59(6) requires the Commissioner to keep a written record and provide a copy on request. Request that record for the response file, and retain later questions against the same requirement numbers.

If a period remains missing, assign a follow-up owner and record the next action. If the NACC changes a requirement, preserve that instruction alongside the original instrument so the next response starts from the agreed scope.
