Res Judicata: Claims, Issues and Prior Decisions

Can an earlier decision prevent the new financial claim? Compare claims, issues, parties and the court record before raising or answering preclusion.

Res judicata prevents parties from pursuing again a controversy finally resolved by a court. In a later financial dispute, identify the precise claim or issue said to be closed before deciding whether the earlier result bars it.

A new allegation about diverted money can concern an adjudicated debt, a decided issue or a separate transaction. The amount alone cannot tell you which. Compare the earlier court record with the proposed case before investing in another round of evidence.

What Res Judicata Means for the New Case

The finality question is what the earlier decision settled between the people now litigating. In its strict sense, res judicata concerns rights and obligations merging into a final judgment. Cause-of-action estoppel and issue estoppel have distinct operations, explained in Tomlinson v Ramsey Food Processing Pty Ltd at [20]-[23].

A cause of action is the legal right asserted through the claim. Issue estoppel concerns a particular ultimate question of fact or law necessarily resolved along the way. A claim can therefore differ from the earlier claim while depending on an issue already settled.

Start with the court’s jurisdiction and the legal effect of its actual orders. Identify the right decided, the relief granted or refused and whether the relevant determination is final. A document titled “orders” does not explain those matters by itself.

Clayton v Bant illustrates why precision matters when earlier proceedings occurred overseas. The High Court required comparison of the rights available in each proceeding. Similar descriptions of financial relief did not establish that the same right had been resolved.

Compare Cause-of-Action and Issue Estoppel

Compare the earlier claim with the proposed claim separately from the issues each requires the court to decide. Use the operative pleadings, then test your comparison against the orders and reasons.

ComparisonCause-of-action estoppelIssue estoppel
What is said to be closed? The claim to a right or obligation already determinedAn ultimate factual or legal issue necessarily determined
What must match? The relevant legal right asserted in the earlier and later proceedingsThe precise question and its legal context
Who is bound?Parties or their relevant priviesParties or their relevant privies
What establishes finality? The final determination of that claim by a competent decision-makerThe final determination of the necessary issue
What does the comparison require? The earlier claim and disposition beside the proposed cause of actionThe earlier determination beside the issue needed for the new claim

“Privies” are people legally identified with a party for this purpose. A shared financial interest, common director or participation as a witness does not itself establish privity. Identify the legal interest represented or derived, and the capacity in which each person litigated. Tomlinson rejected an estoppel against a worker despite earlier enforcement proceedings benefiting him.

For each alleged issue estoppel, write the proposition the earlier court necessarily decided. Attach the paragraph establishing that decision and explain its role in the result. Then identify the proposition the later pleading requires.

Incorrect comparison: a bank transfer appeared in the earlier evidence, so its purpose is closed to further argument.

Correct comparison: identify whether the court necessarily determined that transfer’s purpose, and whether the later claim requires the same question to be answered differently. A witness’s allegation or a passing observation in reasons does not establish that connection.

Assess Anshun Estoppel Separately

Anshun estoppel addresses a claim or issue omitted from the earlier proceeding when its connection made that omission unreasonable. Availability alone does not establish unreasonableness.

In Timbercorp Finance Pty Ltd v Collins, the High Court rejected an approach based on degrees of similarity. Its discussion at [55]-[62] applies Port of Melbourne Authority v Anshun Pty Ltd to practical opportunities and the risk of inconsistent judgments.

For an omitted financial claim, investigate these points:

  • Identify the earlier proceeding’s subject matter and the connection of the omitted claim to it.
  • Establish whether the earlier court could determine the right and grant the relief now sought.
  • Record when the transaction became known and what records were available while the earlier case could still address it.
  • Explain the practical opportunity to raise it, including the scope of any representative proceeding.
  • Assess the explanation for omission and whether success now would conflict with the earlier result.

A later-discovered transfer needs that analysis. Its discovery can explain an omission, but the description “new evidence” does not itself defeat preclusion. Conversely, a transfer appearing somewhere in a large statement bundle does not establish that pursuing a separate claim was then reasonable or practicable.

In Clayton, the High Court rejected the equation of a right being available with a requirement to assert it. The party seeking the stay had to establish the factual basis for the asserted estoppel, including unreasonableness where Anshun estoppel was alleged.

Build the Prior-Proceedings Record

Build one indexed record that lets you compare the concluded case with each proposed allegation. Preserve the versions that governed the determination, including amendments and any narrowed issues.

RecordWhat to extract
Operative pleadings and particularsRights asserted, defences, counterclaims and the transactions identified
Party and capacity recordsPersonal, company, trustee or representative capacity and any asserted privity
Final orders and reasonsThe disposition and the issues necessarily resolved
Consent terms and settlement documentsThe orders actually made, agreed scope and any separate release
Procedural historyAmendments, abandoned issues, appeals and orders changing the earlier result
Proposed pleading and transaction scheduleThe right now asserted and the source evidence supporting each allegation

A consent judgment can create preclusion. Read its actual terms and identify what it resolves. Keep any contractual release as a separate question. Clayton’s discussion at [52], including footnote 83, recognises that res judicata can arise from a consent or default judgment.

A Fictional Loan and Diverted Payment

Suppose Harbour Lending obtains judgment against its borrower for a $120,000 loan debt. The reasons necessarily determine that a disputed $20,000 payment did not discharge that loan. A later claim seeking a declaration that the same payment discharged the debt raises the earlier determination directly.

Change the proposed case. The borrower now alleges that an agent diverted a different $20,000 payment intended for another account. Matching amounts do not make the transactions identical. Compare the recipient, account, payment reference and legal obligation, then examine party identity and Anshun estoppel separately.

Change the evidence again. A newly obtained statement traces the original disputed payment through an intermediary account. That document supplies more evidence about the original transaction. It does not automatically turn the adjudicated dispute into a fresh cause of action.

For each version, record the transaction identity, the earlier determination and what remains unresolved. Identify which parts of the proposed case depend on a closed issue.

Where the record spans many statements, FinTrace saves lawyers and forensic accountants hours of manual statement review. Its searchable ledger brings transactions together, while findings cite the source PDF filename and page. That evidence helps the legal team compare payments across the two cases without searching the bundle again.

Raise or Answer the Preclusion Ground

Raise each asserted bar through the procedure of the court hearing the later case. Keep the legal ground separate from the application seeking dismissal, a stay or another order.

In NSW proceedings governed by the Uniform Civil Procedure Rules, plead the material facts supporting the estoppel. Rule 14.14 requires specific pleading of matters making the opponent’s case not maintainable or otherwise causing surprise. The Judicial Commission’s pleading guidance also explains material facts under rule 14.7 and particulars under rule 15.1.

Identify the earlier proceeding and final orders. State the claim or necessary issue relied on, the relevant parties or privies and the asserted effect on identified paragraphs of the later pleading. Support the application with the court record and evidence needed to establish any disputed premise.

The NSW summary-disposal guidance distinguishes summary dismissal under rule 13.4 from striking out a pleading under rule 14.28. Select the power that fits the relief sought. A dispute about party capacity or the meaning of incomplete earlier orders can affect whether early disposal is appropriate.

When answering the ground, identify the precise missing element. Support a changed capacity with the relevant appointment or title documents. Support an unresolved issue with the operative pleading and reasons. If relying on a recognised exception, identify its authority and prove its conditions. Dissatisfaction with the earlier result supplies no substitute for that analysis.

Failure to establish an estoppel does not dispose of a separately supported abuse of process ground. UBS AG v Tyne illustrates that distinction. Keep the factual and procedural basis of that objection separate.

After the ruling, mark each proposed claim and issue as barred, available or subject to further determination. Record the controlling order beside it and revise the transaction evidence schedule to match. The next stage of the case must proceed on the issues the court has left open.
