Cease and Desist Letter Template
Build an editable civil demand from your verified facts, requested action and response details.
Prepare the letter
Complete the Letter Fields and Edit the Draft
This cease and desist letter template builds an editable civil demand from the rights and facts you supply. It covers commercial financial and estate-property disputes for instructed practitioners.
Enter each party’s name and capacity, the client’s asserted right and the conduct reported by the client. Record supporting documents separately so their contents can be checked against the allegation.
Unfilled fields: Letter date, Response deadline. Blank fields are omitted from the letter.
The draft updates beside the fields. Direct edits remain until you change an input. Copy the letter or download an editable RTF document before changing the particulars again.
Processing stays on your device. Matter entries are not uploaded or saved between visits. Downloaded documents remain wherever you save them.
Separate Allegations, Evidence and the Undertaking
The asserted right, reported conduct and supporting material have separate fields and separate headings in the draft. Each field keeps your wording, including any qualification or uncertainty.
Describe the precise conduct you ask the recipient to stop. The optional preservation request asks the recipient to retain identified material without alteration. Clear either optional field to remove its entire clause.
The undertaking field proposes a voluntary promise by the recipient for separate consideration. Generating this proposal does not create a court order, establish a legal right or bind the recipient.
This pattern does not prepare a solicitor’s undertaking or execution block. Any undertaking you intend to obtain requires separate review of its terms, authority and formalities.
Read an Australian Worked Letter
The starting example is fictional. Example Legal acts for Harbour Ledger Pty Ltd in a dispute about disclosure of confidential financial records by a former consultant.
The asserted right cites a consultancy agreement. The reported conduct describes forwarding a transaction spreadsheet to a personal email account. The evidence field identifies the agreement and a client-provided email export.
The requested action is to cease unauthorised disclosure and use of those records. The optional clauses ask for preservation and propose a voluntary undertaking. They do not turn the reported conduct into a finding.
Change the parties, conduct or requested action to see that part of the letter change. Address details sit above the factual account, followed by the request and response arrangements.
Letter and response dates start unfilled. Set dates appropriate to the matter after considering urgency, delivery and a reasonable opportunity to respond. The tool supplies no universal response period.
Check the Letter Before Sending
Review the applicable NSW professional conduct rules and the matter’s jurisdiction before sending.
- Confirm the retainer, client authority and every person’s capacity. Check whether the recipient has a solicitor and who may receive the letter.
- Compare each factual statement with its supporting material. Remove unsupported allegations and check confidentiality, privilege and any disclosure restriction.
- Limit the requested acts to rights the client can properly assert. Review each preservation request and proposed undertaking for scope and practical compliance.
- Choose the response period and delivery method for the matter. Check the final address, contact details and attachments.
- Review the complete edited document before using it. Remove every remaining unfilled item or complete it from verified instructions.
The Queensland Law Society’s conduct guidance explains restrictions on misleading or intimidating demands. It also addresses improper threats of criminal or disciplinary complaints to secure civil payment.
The Law Council’s conduct-rules overview explains their state and territory framework. Selecting a jurisdiction here records a review prompt and does not determine which rules govern your matter.
Clear all removes every input and the draft from this tab. Blank fields are omitted instead of appearing as fill-in tokens. Generating or downloading the text does not send it.
For the letter’s legal effect and response options, read the cease and desist guide. Defamation, intellectual-property infringement and personal harassment letters are outside this template.
