Notice of Discontinuance Form Preparation
Prepare a supported NSW notice from your case details, then review retained claims and completion checks.
Prepare your notice
Select the Court and Official Form
This notice of discontinuance form tool prepares the NSW Local Court General Division civil pattern for a sole plaintiff. It uses UCPR Form 33, version 2. The editable draft follows its court, party and notice sections.
The other court choices withhold the draft. Selecting a family court or a different division cannot relabel the NSW pattern. Representative proceedings and discontinuing a cross-claim itself require a different preparation process.
The official UCPR forms list supplies the prescribed document. Transfer the reviewed particulars into that form and retain its required formatting and attachments.
Enter the Proceeding and Claim Scope
Enter the case number, sole plaintiff and each defendant. Choose the whole plaintiff’s claim or all claims against one named defendant. A subset of relief against the same defendant is outside this pattern.
Record surviving claims separately, including any cross-claim. Confirm that you have reviewed them before using the draft. The completion record keeps this review separate from the notice’s operative wording.
The fictional example discontinues the plaintiff’s claim against River Trading Pty Ltd. The claim against Coast Services Pty Ltd and River Trading Pty Ltd’s cross-claim remain. The notice therefore uses the named-defendant wording.
Missing particulars appear as incomplete entries beside the draft. An unconfirmed authority or permission adds a missing check. These warnings remain in the completion record when you download the document.
A whole-claim selection requires None or a description beginning Separate cross-claim in the remaining-claims field. Reconcile the selected scope with your pleadings before continuing.
Review and Export the Draft
Edit the notice directly, then copy it or download a Word-compatible document. Print opens a printable document. The download and printout include the separate practitioner completion record after the notice.
Confirm client authority, the exact claim scope and every required consent or leave order. Complete signatures and any consent terms. Check filing requirements and any service directions. Give each party a sealed copy for their records.
Legal Aid NSW’s discontinuance instructions explain the consent and filing steps. A party not served with originating process can require an accompanying affidavit.
Preparing or downloading the document does not file it, obtain permission or determine costs. Read the notice of discontinuance guide for permission, costs and the consequences of ending a claim.
