Recipient and execution checklist
- Confirm the receiving institution’s required wording, original count, asset identifiers and permitted acts. Obtain its requirements before settling the draft.
- Verify the principal’s and representative’s full legal names, addresses, capacities and identity evidence against source records.
- Confirm witnesses, signing location and required attestation with the instructed practitioner and the relevant consular office or notary.
- Confirm the applicable authentication route and whether the recipient accepts the proposed instrument and attachments. Record the response.
- For the Sydney consular acknowledgement route, check personal appearance and bring the required unsigned documents. Confirm its two-ID requirement and copies.
- For an Australian notarisation and DFAT route, confirm the required certificate and original or copy acceptance before notarisation and legalisation.
- Have the instructed practitioner settle the instrument and execution wording. Enter actual signing particulars only through the applicable execution process.
Your particulars stay in this tab. Reloading clears changes. Export your draft before leaving.
Name the Principal and Representative
This Philippine power of attorney template assembles a special authority draft for a defined financial transaction. Enter each person’s full legal name, address and capacity.
Unanswered fields stay marked “Completion required” in the preview and exported package. Entering a name does not establish that person’s capacity or authority.
A special power records defined acts. Under articles 1876 to 1878 of the Philippine Civil Code, general agency and specially authorised acts have different scopes. Have the instructed practitioner settle the authority needed for this transaction.
Describe the Asset and Authorised Acts
Name the receiving institution and identify the asset or account. Enter one authority per line, using the categories Signing, Receipt or Administration.
Separate the category, authorised act and limit with vertical bars. Add clause inserts a receipt, transfer-signing or administration clause for you to complete.
Each inserted clause keeps its unanswered limits marked. Replace those words with transaction limits, including the permitted payment destination for receipt authority.
Load example inserts fictional María Example and José Example, with asset reference REF-204. The signing row permits only a refund release form. The separate receipt row directs the refund to the principal’s nominated account and excludes cash collection.
Keep those powers separate when editing. Permission to sign a transfer document does not itself insert permission to receive proceeds. Record additional restrictions and when the appointment ends.
Prepare the Execution Package
Copy package and Download text export the current editable draft, its authority schedule, unresolved questions and recipient and execution checklist. Changing an input replaces manual draft edits.
The checklist remains when every field has text. A populated sample is not executed, authenticated or accepted merely because names appear.
Send the draft to the instructed practitioner and receiving institution to settle required wording, witnesses and identity evidence. Record their requirements before arranging signature.
The Sydney Philippine Consulate’s acknowledgement instructions require signatories to appear with unsigned documents and identity evidence. Its instructions distinguish signatories from the attorney-in-fact and witnesses.
For an Australian notarisation route, DFAT’s legalisation instructions require confirmation of the recipient’s certificate and document requirements. An apostille or authentication process is separate from the recipient accepting the powers and wording.
Use the Philippine special power of attorney guide for the wider execution and recipient-acceptance process. Find other document drafts in the templates directory.
