Affidavits: Facts, Witnessing and Financial Exhibits
Writing or checking an affidavit? Separate facts from argument, choose the correct form, verify the exhibits and complete valid witnessing.

An affidavit is written evidence that a person swears or affirms is true before an authorised witness. Preparing one requires the correct court form, facts the deponent can explain and properly identified supporting documents.
For financial evidence, connect each amount to its source record before arranging execution. A signed allegation does not establish where money went merely because it appears in an affidavit.
What an Affidavit Proves
An affidavit gives the court a witness’s evidence about relevant facts. The deponent is the person making that evidence under oath or affirmation. The court still decides its admissibility and weight.
Keep the different documents distinct:
| Document | Its function | What to check |
|---|---|---|
| Affidavit | Gives written evidence under oath or affirmation | Court form, factual basis and valid execution |
| Witness statement | Records a witness’s account in the form required for the proceeding | Whether the forum requires a statement, affidavit or oral evidence |
| Submissions | Explain the legal argument and orders sought | Authorities and the connection between the evidence and proposed result |
| Statutory declaration | Declares facts under the relevant statutory declaration law | Prescribed form and eligible witness for that declaration |
A statutory declaration does not automatically satisfy a requirement for an affidavit. The South Australian witnessing guide explains the deponent’s oath or affirmation and the signing certificate, called the jurat.
The deponent remains responsible for the account even when a solicitor drafts the document. Interview the witness about what they observed, what they read and what someone else told them. A drafter’s inference about a payment does not become the witness’s personal knowledge through signature.
An innocent mistake calls for prompt correction through the applicable procedure. Knowingly false evidence raises separate criminal consequences. Queensland’s affidavit guidance expressly identifies knowingly false statements as potentially criminal.
Preserve the executed version when an error emerges. Identify the wrong paragraph and correct fact in further sworn evidence where the rules or directions permit. Obtain any required leave and serve the correction. Do not replace a filed PDF silently. Contested financial family-law evidence needs the specialised family court affidavit process.
Facts, Information and Argument
Separate what the deponent personally knows from information obtained elsewhere and the legal conclusions sought from the court.
First-hand facts describe an observation or action: the deponent operated an account, downloaded a statement or authorised a transfer. Record-based evidence identifies the record and explains how the deponent obtained or used it. Merely reading a statement does not establish who received the funds or why.
Information-and-belief evidence requires a permitted evidentiary basis. Where section 75 of the Commonwealth Evidence Act 1995 applies, interlocutory hearsay can be admitted with evidence of its source. This exception concerns proceedings before final determination. It is not a general permission to repeat unidentified claims in every affidavit. Apply the governing evidence legislation and procedural rules to the particular hearing.
Use a source attribution such as “Priya Shah, the accounts manager, told me during our reconciliation meeting that she authorised the transfer”. Establish whether that evidence is permitted. Where direct evidence is needed, obtain Shah’s own account and the authorisation record.
Supported Financial Evidence and an Unsupported Allegation
The following comparison is fictional.
| Wording | What it establishes | What remains to be proved |
|---|---|---|
| “I downloaded the company’s statement from its banking portal. Page 2 records a $4,000 debit described as ‘TRANSFER T82’.” | The witness’s action and what the identified statement records | Destination, recipient and purpose |
| “The director stole $4,000 and hid it overseas.” | An allegation without the supporting factual chain | Recipient account records, authority and evidence supporting dishonesty or an overseas destination |
The first paragraph identifies an observable fact. The second needs evidence from the person who authorised the payment or records identifying its destination. Keep legal argument about misappropriation in submissions. Explain the foundation for bank statements as evidence separately from the account of what a witness saw.
Forms, Paragraphs and Exhibits
Select the form by the court, proceeding and purpose before drafting the factual paragraphs. A form number alone cannot identify a suitable template.
- Read the originating document and latest directions to identify the court, division or list and case number.
- Identify the affidavit’s purpose. It can support an application or answer evidence. Procedural evidence, such as proof of service, can require a specific form.
- Open the issuing court’s official forms directory. Match the form title and governing rule before downloading its PDF or Word version.
- Use the required caption and deponent particulars. Put separate subjects in consecutively numbered paragraphs and identify supporting documents where they are discussed.
- Apply that forum’s exhibit certification, pagination and filing directions to the assembled document.
Official Form Routes
| Forum | Official route | Selection point |
|---|---|---|
| NSW Supreme, District and Local Courts under the Uniform Civil Procedure Rules | NSW UCPR forms | General affidavit Form 40 is distinct from affidavit of service Form 41. The directory supplies Word and PDF versions |
| Queensland Supreme, District and Magistrates Courts under the Uniform Civil Procedure Rules | Queensland Courts forms | Choose UCPR Form 46, Affidavit, and the appropriate exhibit certificate. Other Queensland regimes also use the number 46 |
| Federal Court of Australia | Federal Court Rules forms | Form 59 is the affidavit under rule 29.02. The directory supplies Word forms |
| Supreme Court of Victoria, civil proceedings | Civil affidavit sample and template | Follow the linked template and the Court’s single paginated affidavit-and-exhibits requirements |
| County Court of Victoria | County Court forms and fees | Select the civil jurisdiction and relevant affidavit purpose before using a precedent |
| Magistrates’ Court of Victoria | Magistrates’ Court form finder | Search by application or affidavit purpose. Form 13D is an affidavit in support in the civil jurisdiction |
| Victorian Civil and Administrative Tribunal (VCAT) | VCAT affidavit proforma | Match the tribunal’s directions and the particular list’s evidence requirements |
| Supreme Court of Western Australia, General Division civil matters | General Division civil forms | The affidavit entry identifies Order 37 and the state oaths legislation |
| Magistrates Court of Western Australia | Magistrates Court forms | Civil Form 2 and the criminal general affidavit are different documents |
| South Australian courts | CourtSA prescribed civil forms | Choose the court and proceeding first. Form 12 and the accompanying exhibit route appear within the relevant court tables |
| Federal Circuit and Family Court of Australia | Preparing an affidavit | Follow the separate family-law or general-federal-law form route appropriate to the proceeding |
For a Queensland Form 46 search, confirm that the result says Uniform Civil Procedure Rules 1999. For an NSW Form 40 search, confirm the NSW UCPR issuer. Neither number establishes suitability for probate, a tribunal application or another state.
Annexure and exhibit conventions differ. The Federal Court affidavit rules distinguish documents annexed to the affidavit from originals or oversized documents that must be exhibited. Use the issuing forum’s certificate and assembly rules.

Completed Fictional Financial Example
The following training example uses invented people and records. It shows factual content for an affidavit, not a document to sign or file. The caption is illustrative. Actual event dates belong in a real affidavit. Execution dates and signatures must be completed during the real witnessing process.
Illustrative caption: Federal Court of Australia, Victoria Registry, proceeding VID EXAMPLE/2026. Applicant: Harbour Sample Pty Ltd. Respondent: Morgan Sample. Affidavit of Alex Example, filed for the applicant.
Deponent particulars: Alex Example, 10 Example Street, Exampletown, Victoria, company accounts officer.
Fictional factual paragraphs:
- I am the applicant’s accounts officer. I operate its account ending 4821 and download its statements from the banking portal.
- After the first statement period ended, I downloaded Statement-4821.pdf. Its account heading names Harbour Sample Pty Ltd and account ending 4821.
- Page 2 records a $4,000 debit described as “TRANSFER T82” during the first statement period.
- A second debit, $1,500, appears on page 3 with description “TRANSFER T91” during the same period.
- I prepared Calculation-A.pdf from those two entries. I added $4,000 and $1,500 to obtain $5,500.
- The bundle marked AE-1 contains Statement-4821.pdf followed by Calculation-A.pdf. The statement occupies bundle pages 2 to 4. The calculation occupies bundle page 5.
- The statement descriptions do not identify the receiving account holder. I have not obtained a receiving-account statement.
Fictional AE-1 cover sheet: Same proceeding caption. Deponent: Alex Example. Document description: bundle containing the three-page Statement-4821.pdf followed by the one-page Calculation-A.pdf. Mark: AE-1. Cover sheet: bundle page 1.
The authorised taker completes the forum’s certificate identifying AE-1 against Alex’s affidavit, with the actual place and execution date. Required signatures belong on that certificate.
Jurat fields for the example: Deponent: Alex Example. Selection: affirmed. Place: Melbourne, Victoria. Execution date: completed at witnessing. Deponent signature: signed at witnessing.
Authorised taker: Jordan Example, Australian legal practitioner, illustrative professional address 20 Example Street, Exampletown. Taker signature: signed at witnessing.
Jordan is fictional, and these labels are not prescribed jurat wording. Replace the caption, particulars and factual account with the real matter’s information. Use the actual form’s jurat, identity requirements and annexure certificate. Add applicable AI disclosures only when they truthfully describe how the real evidence was prepared.
Supplementary Evidence and Responses
A supplementary affidavit adds evidence or corrects an identified part of earlier evidence. Keep the earlier executed document intact and identify it precisely. State the new fact or corrected amount and its source. Explain the relevant rule or order where compliance is the affidavit’s purpose.
For example, evidence of compliance with a production order can identify the order, documents delivered, delivery method and receipt. Attach the relevant records under the forum’s rules. Saying “I complied with every order” leaves the factual steps unexplained. Retain the filing and service receipts with the executed versions.
An affidavit answering another affidavit is often described as a response affidavit. “Counter-affidavit” does not establish a separate Australian form. Use that label only where the particular procedure uses it.
Identify the opposing affidavit and paragraph. Then give the responsive facts with source references: “Paragraph 12 describes the debit as $5,500. Statement-4821.pdf page 2 records $4,000.” Address a separate allegation in a separate numbered paragraph. Put the legal consequence in submissions and observe directions governing further evidence or leave.
Swearing, Affirming and Witnessing
An authorised taker administers the oath or affirmation and completes the witnessing requirements. The deponent supplies the evidence and signs in that process. The taker’s signature does not establish the truth of the financial allegations.
An oath is a religious undertaking to tell the truth. An affirmation is its non-religious alternative. Arrange the selected form before execution so the taker can administer the correct words.
- Assemble the final affidavit and identified attachments. Confirm the deponent has read and understands the exact version.
- Establish identity and the witness’s authority under the applicable law. Resolve interpreter or accessibility requirements before proceeding.
- The taker administers the selected oath or affirmation. The deponent gives the required undertaking that the affidavit is true.
- Complete signatures, page attestations and alterations as the law requires. Execute the annexure or exhibit certificates in the required manner.
- Complete the jurat with the actual place and date, the deponent’s signature and the taker’s identifying details and signature.
Follow the forum’s prescribed sequence and words where they differ from this preparation sequence. An email containing a signature image does not by itself perform an oath or affirmation.
Who Can Witness the Affidavit?
Witness eligibility depends on the applicable law and where and how the affidavit is taken.
| Jurisdiction | Practical eligibility check |
|---|---|
| Victoria | Section 19 of the Oaths and Affirmations Act includes Australian legal practitioners, public notaries and honorary justices. A police officer must be at least a sergeant or temporarily in charge of a police station |
| NSW | Use an authorised affidavit taker such as a JP, solicitor, barrister, commissioner for affidavits or notary under the applicable requirements. NSW witnessing guidance distinguishes the authority for different documents |
| Western Australia | The Supreme Court’s execution guidance identifies JPs, public notaries and qualifying experienced legal practitioners. The lawyer’s participation in the proceedings can affect eligibility |
| South Australia | The authorised affidavit witness list includes JPs, commissioners and police officers other than probationary constables. Its statutory declaration list is broader |
| Queensland | The state affidavit procedure distinguishes paper, electronic and remote execution. Match the eligible witness category to the chosen method |
In Victoria, being a doctor or pharmacist alone does not authorise someone to take an affidavit. Those professions’ statutory declaration powers do not confer affidavit authority. A doctor or pharmacist who separately qualifies as an authorised affidavit taker acts in that separate capacity. The Supreme Court’s affidavit taker list identifies the statutory categories.
Likewise, a police officer’s eligibility in South Australia does not establish eligibility in Victoria or Western Australia. Identify the legal authority for the affidavit itself.
Remote Execution, Interpreters and Joint Deponents
Victoria permits electronic signatures and witnessing by live audiovisual link. The Victorian Government Solicitor’s guidance explains the additional statements about remote execution and the copy used by the taker. Existing duties for page signatures and alterations continue.
Arrange a live process that lets the taker observe the required acts and identify the document version. Record whether the taker uses a scanned or electronic copy where required. Retain the executed document and its certified attachments together. Apply a different state’s remote procedure only to an affidavit governed by that procedure.
Handwriting does not answer the validity question. Follow the court’s legibility and document-format rules. For example, the Western Australian Supreme Court’s probate instructions require typed affidavits. A handwritten affidavit accepted for one purpose does not establish that another court must accept it.
Where the deponent needs an interpreter, use the forum’s interpreter process and any required translation affidavit or alternative jurat. For reading or signing difficulties, establish the required assistance and certificate before the appointment. The Federal Circuit and Family Court’s preparation guide identifies alternative jurats for those circumstances.
Two witnesses to events do not automatically make one joint affidavit appropriate. Separate affidavits make each person’s knowledge and execution clear. If a forum permits joint deponents, identify each person’s evidence and provide the required individual undertakings and signature details. Permission to administer an oath to several people together does not establish permission for a shared affidavit form.
Execution Check Before Filing
- Confirm the witness qualifies for this affidavit, location and execution method.
- Match the identity evidence to the deponent’s particulars and required certificate.
- Confirm the affidavit and attachments are the version the deponent read.
- Complete the oath or affirmation and every required page signature.
- Authenticate alterations using the applicable procedure.
- Complete attachment marks and certificates, including the required signatures.
- Complete the jurat and any interpreter, assistance or remote-witnessing statements.
- Retain the executed version and check the filing and service requirements against the directions.
AI restrictions also affect preparation. The NSW Supreme Court’s generative AI practice note restricts generating or rephrasing affidavit evidence and addresses AI-prepared annexures. Establish the permitted use before creating litigation material. Our AI practice note guide explains how to separate evidence preparation from other uses.
Checking Financial Assertions Before Execution
Reconcile each financial assertion to the source statement and calculation schedule before the deponent signs. Keep the distinction between reading a transaction and knowing its purpose visible throughout the affidavit.
For the fictional AE-1 bundle, the verification looks like this:
| Assertion | Original source | Bundle location | Calculation check |
|---|---|---|---|
| Account belongs to Harbour Sample Pty Ltd, ending 4821 | Statement-4821.pdf account heading | Statement pages within bundle pages 2 to 4 | Match account holder and number to the affidavit |
| T82 debit is $4,000 | Statement-4821.pdf page 2 | Bundle page 3 | Copy the debit amount without reversing its sign |
| T91 debit is $1,500 | Statement-4821.pdf page 3 | Bundle page 4 | Confirm the same statement period |
| Combined debits are $5,500 | Calculation-A.pdf page 1 | Bundle page 5 | $4,000 + $1,500 = $5,500 |
The original PDF page number and bundle page number are different references. Preserve both. The calculation proves the total of those entries, while the receiving account holder remains unidentified in the fictional records.
Before execution, complete the following checks:
- Match each account holder, account number and period to the actual source.
- Trace every amount to its statement entry and schedule row.
- Recalculate totals and check refunds, reversals and internal transfers for double counting.
- Keep currencies and debit or credit treatment consistent.
- Confirm that source filenames and page references survive the final bundle assembly.
- Ask the deponent to identify personal observations separately from record-derived facts and information received from others.
- Remove unsupported destination, ownership or dishonesty conclusions.
- Resolve missing records through the appropriate evidence process, then execute the complete final version.
If the amount reconciles but its purpose remains unknown, state the transaction fact and identify the further evidence needed. The affidavit then gives the court a factual account the deponent can explain under questioning.
