Remote Witnessing: Check and Record Legal Execution

Plan remote witnessing by document and jurisdiction. Check the witness, live session, counterparts and retained execution record before relying on it.

Remote witnessing lets an authorised witness observe execution over a live audiovisual link where the applicable law permits it. For a legal team, completion means matching the permitted procedure to the document and keeping the signed copies connected to the witnessed acts.

The procedure depends on the instrument and jurisdiction. An affidavit also requires an oath or affirmation. A video call alone does not establish that either requirement has been met.

Confirm That Remote Witnessing is Permitted

Identify the document and its governing law before booking the session. Record the receiving court or agency, where each participant will be and the authority that permits the proposed witness to act.

Keep separate checks for the witness’s qualification and the permission to use audiovisual communication. A person authorised to witness one instrument is not automatically authorised to take every affidavit. A procedure for a state statutory declaration does not establish the procedure for a Federal Court affidavit.

Distinguish the acts the document requires. Observing a signature establishes what the witness saw. Administering an oath or affirmation requires the deponent, the person making the affidavit, to swear or affirm its contents. Applying an electronic signature is a separate signing choice. The electronic signatures guide explains that choice before you arrange witnessing.

Use the instrument’s legislation and the receiving forum’s rules together. Wills and enduring powers can carry requirements beyond an ordinary witnessed signature. Select their specific procedure before arranging witnesses or exchanging counterparts.

Prepare the Witness and the Document

Give the authorised witness the complete version that the signatory will execute, including every attachment requiring identification or a signature. Finish the factual content and exhibit preparation before the call. The affidavit guide covers that earlier drafting stage.

Nominate a practitioner to control the document version and assemble the returned copies. Before the session, that person must establish the following practical arrangements:

  • Give every participant the same final file and identify it by filename, version and page count.
  • Arrange the identity evidence required by the selected procedure and a way to inspect it clearly.
  • Test two-way sound and video, including a camera position that shows the signing act.
  • Confirm how the signatory will send the signed document and how the witness will return the attested copy.
  • Prepare the applicable jurat or endorsement and identify every page or exhibit certificate requiring signatures.
  • Arrange any interpreter or assistance the signatory needs, using the procedure applicable to that person and document.

Tell participants to stop if the sound or picture fails. A witness must be able to observe the required act as it happens. Sending a photograph of a signature afterwards does not establish that live observation occurred.

Conduct and Record the Witnessing Session

Conduct the session under the procedure you selected for that instrument. Use the following sequence as a practical control, with the NSW and Victorian requirements below supplying the jurisdiction-specific steps.

  1. Confirm who is present. Establish the signatory’s identity through the required evidence and record the witness’s capacity. Identify anyone assisting or interpreting.
  2. Confirm the document. Compare the filename and page count, then inspect the pages and attachments. Resolve a replacement page or changed version before execution.
  3. Administer any required oath or affirmation. For an affidavit, hear the deponent give the required response through the live link. Observing a signature without this step does not complete the sworn or affirmed act.
  4. Observe signing in real time. Keep the signatory and signing act visible, including required initials, page signatures and exhibit certificates. Prevent an off-camera page exchange from becoming an unexplained gap.
  5. Obtain the permitted signed copy. Compare it with the version observed before the witness signs or completes the jurat. Follow the selected rule for a counterpart or scanned copy and its required timing.
  6. Complete the witness’s statements. Add the signatures and remote-witnessing wording required for this document. Return the completed copy to the practitioner responsible for assembly.
  7. Check and retain the execution record. Reconcile every signed page with the session version and preserve the required originals, counterpart pages and transmission messages.

Make a contemporaneous file note describing the identity check, participants and locations. Record the document version, the acts observed and when the signed copies were received. Note any interruption and how the affected act was repeated or the session abandoned.

A file note is separate from an audio or video recording. Before recording, establish the applicable recording law and obtain informed consent from all participants. Agree on access and retention arrangements. A recording cannot supply a signature, oath or endorsement omitted from the execution procedure.

If identity remains uncertain, stop execution. If visibility or the connection fails during a required act, restore the link and repeat the affected step under the applicable procedure. If pages differ, resolve the version and arrange fresh execution where needed. Leave the document marked incomplete until the practitioner can establish what was validly done.

Check NSW Remote Witnessing Requirements

For remote witnessing in NSW, section 14G of the Electronic Transactions Act 2000 requires live observation, the witness’s attestation and a remote-witnessing endorsement. The witness must be reasonably satisfied that the document they sign matches the document signed by the signatory.

NSW Communities and Justice guidance describes two ways to complete attestation. The witness can sign a counterpart or countersign the scanned signed document as soon as practicable. The endorsement must identify the witnessing method and state compliance with section 14G.

For an affidavit, also complete the applicable oath, identity and authorised-witness requirements. The remote scheme does not itself permit electronic signing or remote certification of a true copy. Select an electronic signing method only where another applicable law permits it.

Before relying on the result, compare the returned pages with the witnessed version and check every required signature and endorsement. If an original must be retained, include every required part and every signed or endorsed page. Preserve physical pages bearing handwritten marks. One merged scan does not replace those original pages.

Check Victorian Affidavits and Other Instruments

Remote witnessing of an affidavit in Victoria requires an authorised affidavit taker and the affidavit procedure under the Oaths and Affirmations Act 2018. The Act permits audiovisual presence for the deponent’s required acts. Australian legal practitioners are among the authorised affidavit takers.

Under sections 25 to 27 of the Victorian Act, the deponent signs each page and the affidavit. The deponent also signs or initials alterations and signs the certificate identifying a referenced document as an exhibit. The authorised affidavit taker completes the corresponding witness requirements and administers the oath or affirmation.

The Victorian Government Solicitor’s guidance explains that the deponent must say the prescribed oath or affirmation aloud, subject to the applicable disability provisions. Signing silently while the witness watches leaves that act unperformed.

Complete the jurat, the statement recording where and when the affidavit was sworn or affirmed. Include the affidavit taker’s signature, name, address and capacity. When using a scanned or electronic copy, state that the deponent signed and swore or affirmed by audiovisual link. Record that the witness used that copy instead of the original.

Check alterations and exhibit certificates before closing the file. A statutory declaration has its own prescribed declaration and completion requirements. Wills and powers of attorney require their own instrument-specific execution process. Reusing an affidavit jurat does not establish compliance for those documents.

Verify Federal Court Affidavit Execution

For a Federal Court affidavit, combine the applicable witnessing authority with the Court’s affidavit rules and any directions in the proceeding. The Federal Court Rules point to section 45 of the Federal Court of Australia Act 1976 for authorised affidavit witnesses. Witness qualification alone does not establish permission for the proposed remote method.

Identify the legal basis for audiovisual execution where the affidavit will be made. Record how it operates with the Federal Court requirements. If the proposed procedure does not establish that basis, arrange in-person execution or obtain an appropriate direction before relying on the document.

The Court’s Technology and the Court Practice Note addresses electronic preparation and lodgement alongside the rules. Permission to lodge a scanned affidavit does not itself establish how the affidavit may be sworn.

Before filing or service, check the completed document against Division 29.1 and the case directions:

  • Use Form 59 and ensure the execution details identify the person before whom the affidavit was sworn or affirmed.
  • Check the deponent’s and witness’s signatures on each affidavit page, subject to applicable disability provisions.
  • Confirm consecutive page numbering through the annexures. Check the required identifying certificates for annexures and exhibits.
  • Check the witness’s signature on the first page of each exhibit and preserve the exhibit numbering sequence across that deponent’s affidavits.
  • Match the jurat and any remote endorsement to the actual session and the signed copies retained on file.

Keep the execution file together with the final affidavit and matching attachments. Release it for filing only when the responsible practitioner can connect the authorised witness, permitted remote procedure and completed document without an unexplained gap.
