Practising Certificates: Solicitor Duties
Manage solicitor practising certificate duties, from application and renewal to conditions and interruptions. Keep authority and active matter cover clear.

A practising certificate establishes a solicitor’s current authority to practise within its conditions. You must apply through the relevant jurisdiction, make the required declarations and keep authority current while matters remain active. Admission alone does not complete that task.
For a financial litigation team, certificate management also means knowing who can take over a matter if a solicitor’s authority changes. Record the permitted work alongside the person responsible for each deadline.
Confirm the Right to Practise
Confirm admission, current certificate status and the conditions covering the intended work before accepting instructions. Each answers a different question.
Admission makes someone an Australian lawyer. Under section 6 of the Legal Profession Uniform Law, an Australian legal practitioner is an Australian lawyer holding a current Australian practising certificate. The Legal Practice Board of Western Australia explains these statutory definitions. A name on an admission roll therefore establishes a different fact from a current certificate.
The certificate’s category and conditions determine the permitted practice. An employee certificate does not authorise its holder to practise as a principal. A supervision condition can also limit how otherwise permitted work is performed. Read the issued conditions alongside the category, including any trust-money restriction.
NSW solicitors apply to the Law Society of NSW when NSW is their principal place of practice. Its application guidance directs practitioners based principally elsewhere to that jurisdiction’s authority. In Victoria, the Victorian Legal Services Board and Commissioner (VLSB+C) issues solicitors’ certificates. Queensland solicitors use Queensland Law Society (QLS).
An Australian certificate can support interstate practice subject to the applicable conditions and local requirements. It does not create a second certificate application for every matter across a border. The Law Society’s interstate practice guidance directs NSW holders to contact the destination regulator and insurer before commencing interstate work.
Application, Renewal and Declarations
Use the issuing authority’s application or renewal process and answer its declarations personally from the supporting records. There is no single national application form.
Prepare your admission information, practice details and the category sought. Gather the records explaining any fitness disclosure or supervision change. Keep the insurance evidence with them. Retain continuing professional development (CPD) compliance records and any exemption or rectification material relevant to the declaration. Detailed education planning belongs in the legal CPD guide.
Jurisdiction Requirements Compared
| Jurisdiction and authority | Application and renewal route | Declarations and fees to resolve |
|---|---|---|
| NSW: Law Society of NSW | New applicants complete the grant form with supporting documents and fees. The Society’s renewal guide uses its online member portal. | The renewal guide covers fitness, show cause events and CPD declarations. The certificate fee is common across categories, while principal and employee categories attract the Fidelity Fund contribution. Optional membership is separate. |
| Victoria: VLSB+C | Apply and renew through LSB Online with the correct practice or organisation recorded. | Renewal includes fitness disclosures and a CPD declaration. Pay the category fee, any applicable Fidelity Fund contribution and required insurance. |
| Queensland: QLS | Apply through myQLS and follow the separate individual renewal process even when the employer arranges payment. | Resolve suitability disclosures and the information requested by the individual form. Certificate fees distinguish principal and non-principal practice. Fidelity contributions and insurance apply where required. |
The NSW renewal guide sets out the declaration categories. Its fee guidance separates certificate costs from membership and Fidelity Fund contributions. Use the form for your renewal period when completing the declarations.
The Victorian renewal requirements also explain when a timely application and payment allow continued practice pending a decision. Missing the renewal boundary requires a new application and interrupts authority while it is considered. Copy the regulator’s deadline into the practice register instead of assuming that an employer’s payment arrangement completes renewal.
Fees can change with the certificate category and commencement period. For example, Victoria’s published full-year certificate fees for 2026–27 are $471 for an employee and $283 for a corporate legal practitioner. Those certificate fees do not attract GST and exclude separate applicable contributions and insurance. The Victorian fee schedule identifies each category and commencement band.
QLS publishes a renewal process for individuals and employers and a separate fee schedule. An employer’s selection of the costs it will pay leaves the practitioner’s renewal application to be completed.
Fitness disclosures can also require action during the certificate period. For example, VLSB+C requires notification within seven days of a show cause event. Bankruptcy and specified criminal or tax events can trigger this process. Follow its fitness and conditions guidance when an event occurs, rather than leaving it for annual renewal.
Conditions, Changes and Interrupted Authority
A change of role requires a fresh comparison between the work proposed and the authority your certificate gives you. Updating an employer’s name alone does not change the permitted category.
In NSW, supervised legal practice and practice management requirements are distinct conditions. Completion of supervision does not automatically authorise principal practice. Resolve a required practice management course condition before continuing the principal-certificate application. The Law Society’s certificate conditions also distinguish trust-money authority from the practitioner’s role. An “unrestricted practising certificate” label must be read against the actual category and remaining conditions.
Corporate legal practitioner status concerns in-house legal work for an employer or a related entity. VLSB+C’s corporate lawyer guidance explains that a corporate certificate does not authorise personal legal services for individual directors or employees. Advising the employer about an employment dispute and advising its director about a private family dispute are different instructions.
Queensland uses an employee-level certificate with an in-house restriction for corporate counsel. Its certificate categories also distinguish restricted from unrestricted employee practice. The terminology therefore needs to be recorded jurisdiction by jurisdiction.
When moving into private practice, obtain the category and insurance appropriate to the new role before undertaking its work. When moving in-house, record the employer and permitted client scope. In Victoria, modifying a certificate is a separate process from updating contact or employment details.
Matter handover checklist
If authority lapses, is suspended or no longer covers the work, arrange an authorised solicitor to take responsibility for active matters. For a planned interruption, complete the handover before it begins.
- Identify every active matter and its next court, limitation or filing deadline. Record outstanding undertakings and unresolved client instructions.
- Confirm the replacement solicitor’s current certificate and conditions. Assign a supervisor where the replacement’s authority requires one.
- Tell each affected client who is responsible and how to contact them. Obtain any instructions or consent required for transferring the matter.
- Complete required court and other procedural notices. Confirm responsibility for hearings, service and correspondence already in progress.
- Record who will receive financial-analysis reports and deal with further document requests.
- Check that each upcoming deadline has an authorised solicitor and any required supervisor assigned.
For example, a corporate lawyer moving to an employed role in a litigation firm must resolve the certificate category before advising that firm’s private clients. A bank-statement report arriving during the transition goes to the authorised matter solicitor. Delivery of analysis does not restore the departing lawyer’s authority.
Keep the Practice’s Authority Register
Keep one authority register that identifies the responsible solicitor and the evidence supporting their permitted work. Make it usable by the person allocating a new matter or arranging urgent cover.
| Register field | What to retain | Action owner |
|---|---|---|
| Practitioner and regulator | Name, issuing jurisdiction and verified practitioner identifier | Practitioner, checked by the practice’s nominated administrator |
| Current authority | Issued certificate, effective period and category | Practitioner |
| Conditions | Supervision arrangement, trust-money restriction and individual conditions | Practitioner and supervising principal |
| Renewal action | Application deadline, declaration status, fee payment and unresolved regulator requests | Practitioner, with payment support assigned separately |
| Matter cover | Active matters, replacement solicitor and handover acceptance | Matter principal |
| Insurance | Insured entity, policy period, applicable approval or exemption and notification contact | Practice principal |
A legal practitioner number is an identifier used by the relevant authority. Keep its issuing authority beside it. A Supreme Court roll number, a certificate number and a regulator’s account reference identify different records and must not be assumed interchangeable.
For example, VLSB+C’s login guidance says its practitioner number appears on the current certificate and is the lawyer’s username. Where a form asks for a different reference, obtain confirmation from the authority issuing that record. A familiar number on an old document does not establish current authority.
External financial analysts receive a defined analysis brief from the authorised matter solicitor. FinTrace saves hours of statement review by producing a searchable Excel ledger and a findings report with direct source-page references. The solicitor remains responsible for their practising authority and for the legal work on the matter. Record that solicitor’s name on the analysis instructions so a handover has a clear recipient.
Professional Indemnity Cover and Claims Duties
Professional indemnity insurance and a practising certificate are separate requirements. The certificate establishes permitted legal practice, while the applicable insurance rules determine the cover required for that work.
In NSW, the Law Society’s insurance guidance identifies Lawcover as the approved policy provider. Corporate and government practitioners have exemptions for their relevant practice, with separate requirements when volunteering. That NSW arrangement does not establish the insurer or exemption for another jurisdiction.
Victoria generally uses the Legal Practitioners’ Liability Committee for private practice. Its insurance requirements explain approved policies and exemptions, including the position of corporate practitioners undertaking volunteer work. If a lawyer works across multiple practices, each practice needs the applicable cover.
Before accepting work after a move, match the policy to the actual insured entity and practice. Check its period, covered work and required limits, together with exclusions relevant to the engagement. Retain the approved cover or exemption evidence separately from the certificate. Record the insurer’s notification route and the principal responsible for using it.
For a NSW practice insured by Lawcover, its notification form states that the policy requires immediate written notification of a claim or circumstance that may lead to one. A possible circumstance therefore needs attention before a formal demand arrives. Keep the incident chronology and relevant documents available for the notification.
Lawcover’s claims guidance explains who can notify on the practice’s behalf. Assign that responsibility, record the written notification and retain the insurer’s acknowledgement. Complete those steps alongside the matter-cover arrangements when an interruption exposes a missed deadline or possible client loss.
Legal Services Commissioners and Practice Regulators
Send a complaint response to the body handling the complaint and a certificate application or notification to the authority responsible for practising rights. The bodies can exchange information, but their functions and procedures differ. Record the responsible regulator’s official name for your jurisdiction and issue.
Complaint and Certificate Responsibilities
| Jurisdiction | Complaints body | Solicitor certificate authority |
|---|---|---|
| NSW | Office of the NSW Legal Services Commissioner (OLSC), which assesses complaints and can refer matters to the professional councils | Law Society of NSW |
| Victoria | Victorian Legal Services Commissioner | Victorian Legal Services Board, through the VLSB+C certificate process |
| Queensland | Legal Services Commission | Queensland Law Society |
The NSW OLSC guidance for lawyers explains complaint responses and requests for evidence. Victoria’s regulatory powers distinguish certificate powers from complaint investigations and determinations. In Queensland, the Commission’s role description separates complaints from the professional associations’ certificate functions.
When an official request arrives, give it a named response owner and record the steps below.
- Save the request, reference number and delivery record. Identify the issuing body, statutory basis and response deadline. Distinguish an informal enquiry from a compulsory notice.
- Preserve the client file and relevant communications in their original form. Retain billing records and any trust records relevant to the allegation. Keep a separate working chronology so the response does not alter the underlying evidence.
- Answer each issue with the relevant source document. Explain any missing record accurately. If a deadline cannot be met, contact the case officer before it expires and obtain a written response to any extension request.
- Assess confidentiality and privilege against the particular notice. Victoria’s guidance on disclosure required by law explains section 466 document requests. Obtain advice on a disputed production obligation without ignoring the request.
- Check separate notification duties. Compare the event and any resulting order against the certificate issuer’s disclosure requirements and the insurance policy. A complaint alone does not establish that every notification rule is triggered. For a claim or possible circumstance, use the insurer’s notification route described above.
A client complaint asks the regulator to address service or conduct. Costs assessment examines legal costs under its own eligibility rules and deadlines. A certificate condition controls permitted practice. Record each process separately even when the same events start more than one process.
For NSW costs assessment, use the Supreme Court’s forms and fees. In Victoria, the costs-dispute procedure explains the Commissioner’s jurisdiction and the available court or tribunal routes. Queensland’s costs-assessment guidance explains independent assessment and when a court order makes it binding.
On receipt of a condition, suspension or other authority decision, update the authority register from the actual decision and arrange cover for affected work. Confirm that the complaint response is filed, required notifications are acknowledged and each active matter still has an authorised solicitor responsible for its next obligation.
