Supervised Legal Practice: Plan and Record the Work
Plan supervised legal practice with clear supervisor responsibilities, reviewed matter work and certification records for NSW and Victorian requirements.

Supervised legal practice requires a newly admitted solicitor to practise under eligible supervision until the required period is completed and the certificate condition is removed. Plan the work around your practising conditions, agree who reviews each matter and keep records that your supervisors can certify. In NSW and Victoria, time served alone does not remove the restriction.
Identify the Practising Conditions
Read your practising certificate and confirm the supervision period attached to your admission pathway before calculating a completion date. Admission, employment and holding a practising certificate are separate events. In Victoria, the period begins when you have a practising certificate and start legal practice.
For NSW, the Law Society’s supervised legal practice guidance identifies condition 2 as the statutory restriction. Most practitioners who completed a practical legal training course need 24 months of full-time supervised legal practice, or its part-time equivalent. The approved supervised-training pathway, such as articles, requires 18 months full-time equivalent. Victoria also distinguishes the admission pathways. Apply the period for your own qualification and any granted exemption.
Before accepting matter work, record the following details.
- Identify the authority responsible for your certificate: the Law Society of NSW or the Victorian Legal Services Board + Commissioner, as applicable.
- Record the certificate condition, admission pathway and evidence supporting the required period.
- Confirm that your supervisor is authorised to supervise your legal practice in that workplace arrangement.
- Separate eligible legal practice from other duties and record the working pattern used in your calculation.
A job title or a colleague’s seniority does not establish eligibility. NSW supervisors must be authorised by their certificate to supervise others and must be free of conditions preventing supervision. Corporate and government practice have their own qualifying arrangements. If your pathway or work falls outside the standard application, resolve it with the responsible regulator before counting it.
This is the solicitor’s post-admission practising restriction. Later bar training is a separate professional pathway.
Agree the Supervisor’s Review Responsibilities
Name the supervisor who can direct the legal work and approve consequential steps before the junior lawyer takes them. The Victorian guidance for supervisors requires review of the supervised practitioner’s legal work, with authority to amend or intervene. Its practical guidance covers appropriate allocation and regular feedback.
Use a written matter allocation that identifies actual people for each responsibility. The following is a practical allocation model.
| Responsibility | Assigned person | Review checkpoint |
|---|---|---|
| Matter allocation | Supervising solicitor, named in the plan | Confirm the task fits the junior lawyer’s experience and available support |
| Client instructions | Junior lawyer, checked by the supervising solicitor | Resolve unclear instructions before drafting advice |
| Advice and correspondence | Supervising solicitor | Approve the version to be sent before dispatch |
| Urgent issue or absence | Named eligible replacement supervisor | Confirm the replacement can supervise before the junior continues affected work |
Agree how the junior submits work, how the supervisor records approval and what happens when a deadline arrives before review. A draft waiting in an inbox is not an approved letter. Raise the deadline and obtain instructions about the next step. Apply the same allocation to hearing work through the practice’s trial preparation process.
Consider a hypothetical financial dispute. A client describes a $24,000 debit as money spent by the other party. The junior lawyer reconciles the transaction with a matching credit in another supplied account and prepares a proposed letter. The supervisor opens the paired source records and checks the junior’s reconciliation against the client’s instructions. The letter must distinguish an account transfer from evidence of expenditure, and the supervisor approves that distinction before it is sent.
FinTrace can save the team hours of monotonous statement conversion and analysis in that workflow. The service supplies a searchable Excel ledger and clear findings report, with each finding tied to its PDF filename and page. Those references put the underlying evidence beside the financial explanation. The solicitor uses that evidence to frame the legal issue, and the supervisor reviews the junior lawyer’s proposed advice and next action.
Keep a Reviewable Supervision Record
Record work periods and supervision as they happen so the completion application can be reconciled with employment and supervisor records. Keep the period calculation separate from the matter-review record. Billable time alone does not explain which legal practice was supervised.
A practical record can use these fields.
| Record | What to retain |
|---|---|
| Practice period | Start and finish dates, employer, role and practising-certificate details |
| Working pattern | Full-time or part-time basis, ordinary hours and changes during the period |
| Supervisor | Name, authority to supervise and period covered |
| Review meeting | Meeting date, matters discussed, feedback and agreed follow-up |
| Approved work | Matter reference, task, reviewed version and approval record |
| Interruption | Absence or supervision gap, replacement arrangements and treatment in the period calculation |
Keep client documents in the matter file. Use matter references in the supervision record so a summary can be reviewed without copying confidential client material into a separate employment log.
When employment changes, reconcile the completed period and obtain the departing supervisor’s certification while the records remain accessible. The NSW quick guide recommends obtaining certification before leaving a practice. Multiple periods can contribute to completion. Preserve the working pattern and supervisor evidence for each one.
For part-time work, calculate the full-time equivalent under the responsible regulator’s rules. Record leave separately so ordinary leave and an extended interruption receive the correct treatment. A change of hours needs a new calculation segment, even if the employer stays the same.
If a supervisor becomes unavailable, confirm an eligible replacement before continuing legal practice under the restriction. Victoria expressly directs a practitioner with no supervisor to stop practising until an appropriate arrangement is in place. If a former supervisor cannot supply a letter, contact the regulator with the available records. Do not recreate their certification yourself.
Check NSW and Victorian Supervision Requirements
Use the rules and application route for the authority responsible for your certificate, even when the matter or supervisor is interstate. A NSW remote-work arrangement and a Victorian arrangement can require different approval steps.
NSW Supervision Arrangements
Check the proposed relationship against the Law Society’s guidance on supervisor eligibility, the Uniform Law definition and the General Rules. For remote or external arrangements, the NSW remote supervision guidance addresses review before work goes out, file access and confidentiality. It also addresses the supervisor’s authority over instructions and deadlines.
For exclusively remote supervision, retain a supervision plan. The Law Society does not approve or endorse these plans. An external supervisor’s certificate and relationship to the practice need separate attention. Do not assume that video meetings alone establish a qualifying arrangement.
Victorian Supervision Arrangements
The Victorian information for supervisees distinguishes physical remoteness from supervision by someone employed by a different entity. A different-entity arrangement requires Board approval before it starts. Working remotely within the same entity does not require that approval.
Victorian guidance also distinguishes legal practice from work such as paralegal or policy duties. Where a role mixes duties, identify the legal work being claimed. Keep that classification with the period record so the supervisor can explain it.
Practice-wide management responsibilities sit separately from your individual certificate restriction. A legal practitioner director’s role does not replace the required supervision of a newly admitted solicitor.
Apply for Certification and Confirm the Outcome
Apply for removal when the required supervised period is complete and the supporting evidence covers every period claimed. Certification of supervised legal practice supplies evidence for the application. The regulator’s decision changes the condition.
- Reconcile the period schedule with your work records and resolve gaps or inconsistent hours with the relevant supervisor.
- Obtain the required certification or letters from supervisors covering the periods claimed.
- Complete the responsible regulator’s application and declarations, then attach the supporting documents it requests.
- Retain the submitted application and respond to requests for further evidence.
- Confirm the successful outcome and the changed certificate condition before practising without supervision.
For NSW, start at the official application to remove condition 2. The linked form asks for your declaration, each practice period and supervisor certification. Certification letters require wet-ink or digitally certified signatures. Typed signatures are not accepted. Fully remote periods also require a letter co-signed by you and the nominated supervisor explaining the arrangements.
For Victoria, use the online removal application linked from the regulator’s supervisee guidance. Obtain the supervisor letters required for removal and upload them with the application. Assemble the material before starting: the regulator says the online application must be completed in one attempt.
Keep supervision in place while the application is being assessed. A submission receipt confirms receipt of an application. A successful removal decision and a certificate that no longer carries the restriction confirm that you can proceed without that condition.
