Bankruptcy Notices: Issue, Service and Challenges

A bankruptcy notice requires careful checking of the judgment debt, service and response period before compliance or a challenge can be assessed.

A bankruptcy notice is a formal demand based on a final judgment or order against an individual. Failure to comply can create an act of bankruptcy that supports a later court application. The notice itself does not make the debtor bankrupt.

For a solicitor reviewing the notice, establish the amount still owing and the legally effective service date immediately. Those facts determine the response and the time available to protect the client’s position.

What a Bankruptcy Notice Does

A bankruptcy notice requires the debtor to pay the judgment debt or secure or compound it to the creditor’s satisfaction. The Official Receiver issues the notice through the Australian Financial Security Authority (AFSA) on a creditor’s application.

Under section 40(1)(g) of the Bankruptcy Act 1966, non-compliance can constitute an act of bankruptcy. A creditor can then seek a sequestration order through a creditor’s petition. Bankruptcy through that process requires a court order.

Keep the following documents distinct when reviewing a debt-recovery file.

DocumentDebtor and purposeReview consequence
Bankruptcy noticeA formal notice against an individual, founded on a qualifying judgment or orderCheck the judgment and the bankruptcy compliance period
Company statutory demandA demand against a company under the corporate insolvency regimeUse the separate statutory-demand procedure
Ordinary debt collection letterCorrespondence demanding paymentA deadline in the letter does not itself create the bankruptcy-notice process

A company’s unpaid invoice does not become a personal judgment debt merely because its director receives correspondence. Match the person named in the notice to the judgment debtor.

Check the Judgment and Amount Claimed

A bankruptcy notice requires qualifying final judgments or orders totalling at least $10,000, with at least $10,000 outstanding when the application is made. The judgment must be no more than six years old. Execution must not be stayed, and a relevant suspension also prevents issue.

AFSA’s application guidance distinguishes the judgment amount from later interest. Post-judgment interest cannot lift an originally sub-threshold judgment over the qualifying minimum. Interest and quantified costs forming part of the judgment count towards that judgment amount.

Obtain the sealed or certified judgment and any later orders affecting enforcement. An unquantified costs order needs assessment or taxation before it can support the notice.

Prepare a reconciliation that separates each component of the amount claimed.

ComponentSource recordCheck before relying on the figure
Judgment principalSealed judgment or orderUse the amount actually ordered and identify each judgment separately
CostsQuantified order or assessment certificateKeep costs already included in the judgment from being counted twice
Post-judgment interestApplicable judgment terms or court rule and interest scheduleIdentify the permitted rate, calculation period and balance on which interest runs
Payments and creditsBank entries, receipts and creditor ledgerMatch the payment to this debt and record how it changes the balance

Interest after judgment is claimable only where the judgment terms or the relevant court rules permit it. Recalculate it for the period claimed, accounting for payments and their allocation.

In a hypothetical example, a final judgment totals $14,000, including quantified costs. The debtor later pays $5,000 towards that judgment before the creditor applies for a bankruptcy notice. With no interest claimed, $9,000 remains outstanding. The original judgment exceeds $10,000, but the outstanding amount fails AFSA’s minimum for the application.

A payment made after issue requires a further reconciliation for the response to the notice. Record when the payment cleared, its recipient and the debt it discharged. A transfer receipt alone may leave the allocation unresolved if several debts exist between the parties.

Where repayment evidence spans many statements, consolidate the transactions with their PDF page references. FinTrace takes over hours of statement review for lawyers and forensic accountants. Its searchable ledger and findings report put the supporting statement pages beside the analysis, so the professional can locate repayment evidence directly.

Service and the Response Period

For a bankruptcy notice served in Australia, the usual compliance period is 21 days after service. Issue and service are separate events. A notice generally must be served within six months of issue, unless the Official Receiver grants an additional service period.

AFSA identifies personal delivery, post, courier and email as service methods. Each method still needs evidence that establishes valid service. Under section 102 of the Bankruptcy Regulations 2021, electronic service has specific conditions. The transmission must meet the required recipient-facility or expected-receipt test, and the document must be readily accessible for later reference in a permitted format.

Keep the exact notice and judgment sent, together with the server’s contemporaneous account. For post or courier, retain address and delivery evidence. For electronic service, preserve the transmitted attachments and address evidence, including delivery failures or replies.

The Federal Court’s service guidance explains how the method affects the starting point. Hand delivery generally uses the delivery date. Postal service generally depends on when delivery would occur, subject to contrary proof. Electronic service usually runs from transmission. A substituted-service order supplies its own requirements and deemed service date.

Record the service basis before calculating expiry. Where ordinary service cannot be effected, a substituted-service application requires supporting evidence. Service outside Australia requires court leave, and the court’s order specifies the compliance period.

Distinguish the actions available during the response period.

  • Compliance means paying the required debt or reaching an arrangement that satisfies the creditor under the notice.
  • An extension application seeks more time to comply. Identify the power relied on and obtain any necessary interim order.
  • A set-aside application challenges the notice. Filing it does not generally stop the compliance period running.

The Federal Circuit and Family Court of Australia explains the need for separate extension relief. A competent, timely counterclaim application has a specific deemed-extension rule, addressed below. Negotiations or a solicitor’s letter disputing the notice do not themselves suspend the deadline.

Challenges and What Follows Non-Compliance

A challenge needs evidence of a legally available ground, supported by an application made within the applicable time. Identify the defect and the relief sought before treating a dispute about the debt as an answer to the notice.

An overstated amount requires particular care. Section 41(5) prevents excess alone from invalidating the notice unless the debtor gives the creditor notice of the misstatement dispute within the compliance period. That notification does not itself extend time. Section 41(6) also recognises timely compliance by reference to the amount actually due in the circumstances it describes.

Other possible grounds include a substantial or misleading defect, an enforcement stay or an error identifying the parties. Where the underlying judgment is challenged, commence the appropriate proceedings against that judgment and address extension relief separately. An intended appeal or an unanswered complaint does not establish that proceedings have begun.

For a counterclaim, set-off or cross-demand under section 40(1)(g), the claim must equal or exceed the judgment debt. It must be one the debtor could not have raised in the original proceeding. The Federal Court also identifies mutuality between the same parties in the same capacities as a requirement.

Supply the claim’s factual basis and monetary calculation, with evidence explaining why it could not have been raised earlier. Section 41(7) deems time extended where a competent application on that ground is made before expiry and remains undetermined at expiry. The extension lasts through the day of determination.

Under Federal Court bankruptcy rules 3.02 and 3.03, the supporting affidavit identifies the grounds and service date. Attach the notice and any required material about proceedings challenging the judgment. A counterclaim affidavit also needs full particulars and the amount calculation. In the Federal Court, serve the set-aside application and supporting affidavit on the creditor within three days after filing.

For a set-aside application in the Federal Circuit and Family Court of Australia, file Form B2 with the supporting affidavit and notice copy. State the final orders sought and any interim extension order, identifying its statutory basis. Use the chosen court’s approved form and filing requirements. Retain the filed documents and proof of service on the creditor. A request to the creditor for more time does not obtain a court extension.

Before relying on non-compliance for a later petition, complete the final file check.

  1. Confirm that the notice was served within its permitted life and that the evidence proves the method and effective date.
  2. Calculate expiry using every relevant order or deemed extension. Check for applications affecting the notice and retain their outcomes.
  3. Update the debt reconciliation through the proposed next step, including cleared payments and any accepted settlement terms.
  4. Preserve the notice, source records and correspondence, even while a payment arrangement is discussed. Record whether agreement was reached and what the creditor accepted.

If those checks establish an available act of bankruptcy, assess the later creditor’s petition on its own requirements. Keep the debt calculation and service evidence together so the decision to proceed rests on the actual file.

Issue the Notice Through AFSA

Apply to AFSA for the bankruptcy notice before arranging service. The AFSA creditor portal guidance explains the online application and draft-review process.

  1. Match the debtor’s full name to the judgment. Confirm the creditor’s entitlement to enforce it and reconcile the outstanding amount, including payments after judgment.
  2. Prepare the judgment or court-certified copy and the supporting documents relevant to the claim. Include quantified costs material and proof of assignment where applicable. Supply the interest calculation if post-judgment interest is claimed.
  3. Complete the bankruptcy notice application through AFSA Online Services using the professional and creditor services portal. Review the downloadable draft against the judgment and calculation before submission.
  4. Use AFSA’s fees and charges schedule for the bankruptcy notice application fee. The application fee is payable when applying, whether or not the Official Receiver issues the notice.
  5. Review the issued notice before service. Match the parties and amount to the application, and retain the Official Receiver’s endorsement, registration number and issue date. Correct any discrepancy through the proper process before relying on the document.

For a bankruptcy notice involving a NSW judgment, New South Wales identifies the judgment’s court context. The notice procedure remains federal. Obtain issue through AFSA, then use the appropriate federal court for a set-aside or extension application. A letter to the NSW judgment creditor does not file that application or stop the compliance period.

Keep the issued notice and application documents together. Use the endorsed notice for service, then record the effective service date and calculate the response period from that event.
