Child Support Objection Form and Evidence
Challenging a child-support decision? Get the official objection form, then organise your grounds, income records and payment evidence for review.

The official child support objection form is Services Australia’s CS1893. Use it to identify the decision you challenge, explain the error and supply evidence supporting the correction. For family lawyers and forensic accountants, the financial work starts with the decision letter: each disputed input needs a record that shows what must change.
Get the Official Child Support Objection Form
Download CS1893 from Services Australia’s maintained child support objection form page. Return the completed form and supporting copies to Services Australia through the client’s linked Child Support online account, or by post or fax.
The official form instructions specify the online document type and postal or fax details. Care-percentage objections can also be made by phone on 131 272.
When Services Australia notifies your client of another party’s objection, use the separate Responding to an Objection form, CS4243. That response explains agreement or disagreement with their objection. It does not replace an objection your client needs to lodge against a different decision.
Match the Challenge to the Decision
Identify the decision reference, the outcome disputed and the information used before drafting grounds. An objection asks Services Australia to reconsider an existing decision. A change-of-assessment application asks for an assessment to change because of special circumstances. Court proceedings have separate jurisdictional requirements.
Use a short issue schedule to connect the decision with the required evidence.
| Disputed issue | Evidence to connect to the decision | Procedural distinction |
|---|---|---|
| Incorrect income input | Assessment notice, income notice and records explaining the discrepancy for the relevant period | Identify the child-support input challenged. A tax assessment dispute goes to the tax decision-maker. |
| Payment omitted from the account | Bank debit, recipient acknowledgement and the agency’s payment record | Identify whether the decision concerns crediting a non-agency payment. Sending money does not itself establish entitlement to a credit. |
| Incorrect care percentage | Adult records of actual care and the arrangement relied on | Use the care-decision route. A bank transfer does not establish nights of care. |
The Child Support Guide’s non-agency payment rules distinguish a refusal to credit a payment from a decision to grant credit. The right to object depends on the decision and the party objecting.
Most collection actions, including tax-refund interception, do not carry ordinary objection rights. An overpayment itself is not an objection decision, although the decision causing it can carry rights. Services Australia explains these exclusions in its child-support objection process.
For the financial analysis behind a disputed input, use the child support income guide. A separate ATO objection form addresses a federal tax decision.
Record Authority, Receipt and Time Limits
Record your authority to act, the decision letter and evidence of when the client received it. Keep the envelope, electronic notification or client’s receipt record in the private file. An accountant preparing financial schedules needs a clear instruction about who signs and lodges the objection.
Under the objection requirements, an ordinary authority to act does not let a lawyer or accountant lodge an unsigned objection for the client. The client must sign an objection prepared on their behalf. The exception is a representative with power of attorney or statutory rights to deal with the client’s finances.
For ordinary decisions, the objection-period rules require receipt within 28 days after notice. The period is 90 days for a resident of an overseas reciprocating jurisdiction. An appealable collection-refusal decision has a different starting point: when the payee first becomes aware of it. Record the applicable rule before calculating the deadline.
A late ordinary objection needs an extension request. Explain the delay and attach supporting evidence. Under the extension-of-time guidance, an acceptable explanation alone does not secure an extension. The decision also considers the objection’s merits and prejudice, among other factors.
Care-percentage objections can be made at any time. Lodging after 28 days, or 90 days in a reciprocating jurisdiction, generally limits the effective date to lodgement. Special circumstances preventing an earlier objection can permit an earlier effective date. Where a family-assistance care decision also applies to child support, the Guide explains the alternative family-assistance review route.
The agency’s processing period is separate from your lodgement deadline. The objection-decision guidance gives 60 days for the ordinary objection decision, or 120 days where a parent resides overseas in a reciprocating jurisdiction.
Draft the Objection Letter and Grounds
Draft each ground as a specific error, its supporting record and the correction requested. Refer to attachment numbers where the evidence proves the point. Unsupported allegations about the other parent do not explain why a financial input or payment credit must change.
The following child support objection letter sample uses fictional parties and an assumed payment dispute. Adapt its reasoning to the official form and the actual reviewable decision. Alex signs the completed objection. The practitioner’s covering letter does not replace that signature.
To the Child Support Objections Officer
I act for Alex Morgan under the attached authority. Alex objects to the decision identified in attachment A1, received 12 days before this submission. That decision refuses credit for a direct payment of $1,200.
The stated reason is that the payment’s purpose is unsupported. Attachment A2 records the $1,200 bank debit. The other parent’s written acknowledgement in attachment A3 identifies that payment as child support for the disputed period. Attachment A4 reconciles the payment to the agency account and identifies the missing credit.
Alex requests reconsideration of the refusal and credit of $1,200 against the relevant liability. The payment reference and disputed period appear in the attachment index. Please provide the written decision and reasons to the authorised contact recorded on the form.
The example identifies the assumed reason for refusal, so the evidence answers that reason. A debit alone proves an outgoing payment. The acknowledgement supplies evidence of purpose. The agency record shows whether a credit is missing. The applicable payment-credit rules still decide the outcome.
Index Income and Payment Evidence
Index only lawfully obtained records that address a stated ground. Give each attachment a stable reference, its source and the period it covers. Preserve original files separately from the copies prepared for exchange.
For an income issue, connect the relevant income notice to payslips or business records and explain any reconciliation difference. For a payment issue, match the debit to the recipient’s acknowledgement and the agency account. Identify reversals and duplicated entries before calculating the claimed correction.
Two distinctions prevent misleading schedules. A payment made and a payment credited are different events. A bank receipt and assessable income are different classifications: a receipt can be a transfer between accounts, loan proceeds or a refund. Explain the basis for each classification used in the objection.
An attachment index can carry columns for reference, record, period, source page, ground and amount. Keep the full transaction description where it explains the payment. Remove unnecessary contact and third-party details from submission copies while preserving the evidence needed to understand the entry. The bank statements as evidence guide explains source preservation in more detail.
FinTrace takes over hours of statement conversion and review for lawyers and forensic accountants preparing financial evidence. Its searchable ledger and written findings report give you the transaction analysis, with each finding referring directly to the source PDF filename and page. You can use those references in the financial schedule supporting a specific ground.
Submit and Respond During the Objection Process
Submit the completed objection with an indexed evidence set and retain proof of what Services Australia receives.
- Check the decision reference, grounds and signatures against the final form. Confirm the correct lodgement deadline in the private file.
- Review the exchange copies for unnecessary personal information and safety concerns. Raise a risk to anyone’s health or safety with Services Australia.
- Lodge through the documented channel. For online lodgement, the form instructions specify Upload documents and the document type “Objections form/evidence”.
- Save the submitted form, exact attachments and upload acknowledgement or transmission record. For post, retain delivery evidence. Record any later confirmation of receipt.
- Answer further requests by identifying the request and the material supplied. Keep a dated version history in the private case file, preserving earlier submissions.
Services Australia shares the objection and supporting documents with the other party and gives them an opportunity to respond. Information supplied later can also be exchanged. Its form instructions exclude offensive or degrading material, children’s statements, illegally obtained evidence and information that might contribute to family and domestic violence.
The form’s confidential-details pages are withheld during the objection exchange, but are exchanged if the matter goes to the tribunal. Address privacy before submission. Payments continue while the objection is considered. Stopping collection requires a stay order.
Check the Outcome and Available Review
Compare the written outcome with every correction requested and the resulting agency account or assessment. Record which grounds succeed, which remain unresolved and why. Reconcile any revised amount to the accepted income input, payment credit or care percentage. A child support calculator can illustrate formula effects, but its estimate does not replace the objection decision.
The Administrative Review Tribunal (ART) reviews specified child-support objection decisions. Its child-support review guidance identifies reviewable decisions and who can apply. Ordinary first-review applications generally have a 28-day period after receipt, extended to 90 days for residents of reciprocating jurisdictions. A written extension request must explain lateness. Care-percentage reviews have different timing and effective-date rules.
Check representation separately for the tribunal stage. The ART accepts an application made for another person by their lawyer or specified authorised representatives. An accountant’s authority to prepare financial evidence does not itself establish authority to commence that review.
The Federal Circuit and Family Court of Australia’s child-support guidance describes limited court routes. Administrative requirements generally come first. Court departure applications require their own statutory conditions, and an appeal from an ART decision concerns a question of law. Record the decision’s review rights and the next deadline before closing the objection file.
