Power of Attorney: Authority and Financial Duties

Check financial authority under a power of attorney in NSW, Queensland or Victoria, including when it operates and which records to keep.

A power of attorney gives an appointed person authority to act for the person who makes it, within the document’s scope and the applicable law. Financial authority can cover paying bills, operating accounts or dealing with property. Before money moves, establish who can act, when their authority starts and whether the proposed transaction is permitted.

What a Financial Power of Attorney Does

Financial authority allows the attorney to manage the principal’s money and property. The principal is the person granting authority. The attorney can be a trusted adult and need not be a lawyer. Appointment gives the attorney powers and duties, without transferring beneficial ownership of the principal’s funds.

A general power ordinarily operates while the principal retains the relevant capacity. An enduring power can continue despite loss of capacity. “Enduring” describes that continuation, not a requirement to wait for incapacity before acting. The commencement clause decides when financial powers become exercisable.

A limited or special power restricts the authorised work, such as completing one property transaction. “Extended power of attorney” is informal wording, while overseas documents can use “durable power of attorney”. Neither phrase establishes a separate Australian appointment category or proves an imported document works here.

Personal and healthcare appointments require separate analysis. NSW enduring guardianship covers personal and health decisions, while NSW powers of attorney concern financial and legal affairs. Queensland allows financial and personal appointments within its enduring forms. Victoria distinguishes enduring and supportive appointments and uses separate medical-treatment arrangements.

In NSW, the difference between an enduring power of attorney and enduring guardianship is the decision each authorises. Financial authority follows the power’s commencement terms and continues through lost capacity. An enduring guardian acts only when the person cannot make the relevant personal decision. NSW Government’s enduring guardianship guidance explains those functions. A guardian’s appointment alone does not authorise operating a bank account.

NSW documentWhen it operatesDecisions it covers
Enduring power of attorneyDuring life, once its commencement conditions and required acceptance are satisfied, including through loss of capacityFinancial and legal decisions within the instrument
Appointment of Enduring GuardianDuring life when the person cannot make the relevant personal decisionsAppointed lifestyle and healthcare functions
WillAfter deathEstate administration and distribution through the executor’s authority

Someone can hold both lifetime appointments, but each needs its own authority document. For a disputed care payment, retain the personal appointment explaining the care decision and the financial power authorising payment. Keep the will separately for the estate period. The shared person’s name does not make these powers interchangeable.

For a Chinese-speaking principal, NSW Trustee and Guardian provides Simplified and Traditional Chinese power-of-attorney factsheets. Use the appropriate explanation with an interpreter where needed. A translated factsheet explains the concept. It does not translate the signed instrument or establish that the principal understands its particular powers and restrictions.

Checking the Appointment and Commencement

Check the complete executed appointment before accepting an instruction from an attorney. A certified first page cannot establish the conditions on a later page.

  1. Identify the principal, each attorney and any replacement. Compare names with identity documents and the relevant account or title.
  2. Confirm the instrument’s jurisdiction and type. Check the form, execution requirements and the principal’s capacity when granting it.
  3. Separate the principal’s signature from witness certificates and the attorney’s acceptance. Confirm each required signature and qualification.
  4. Read the commencement clause. Retain the medical evidence, specified event or other evidence required by that particular clause.
  5. Check the proposed act against restrictions, transaction limits and any required consent. Identify gifts, self-benefit and other conflicts before authorising payment.
  6. Check for revocation, later appointments and events ending an attorney’s authority. Record the enquiries and any notices received.
  7. Establish the signing arrangement and any land-registry requirements. Give the institution evidence matching the authority actually granted.

Joint and Separate Decisions

Joint attorneys must act together. Several attorneys can act independently within their respective authority. Joint-and-several appointments permit joint or independent action. Read any transaction-specific conditions because a document can require joint action for property sales while allowing separate payment of bills.

In this fictional example, Alex and Priya are appointed to pay a $2,400 care invoice. A joint appointment requires both to authorise the payment. Under a several or joint-and-several appointment, either can authorise it if the document permits that transaction. The bank’s signing arrangements must reflect those instructions.

An unavailable joint attorney does not give the other attorney permission to sign alone. Check whether an appointed replacement can act and whether its triggering condition has occurred. Death, resignation or loss of eligibility can have different effects under each jurisdiction’s law. Retain the evidence before changing access.

Forms, Advice and Cost

A principal can prepare information and complete an official form without buying a commercial kit or retaining a solicitor to draft every field. Required witnessing, certification and acceptance still apply. An online questionnaire or unsigned PDF does not establish a completed appointment.

Separate preparation costs from registration charges and charges for witnessing or certified copies. Obtain a written professional quote identifying advice about capacity, restrictions and conflicts. If the quote includes a will, identify its separate preparation work. A will does a different legal job.

Official Queensland downloads are free. South Australia provides free editable forms, while its explanatory hard-copy kit is sold separately. Registration fees arise where the relevant registry requires lodgement. NSW’s official fees distinguish preparation and storage from acting as attorney.

Service NSW identifies free preparation eligibility for people eligible for a full Centrelink Age Pension, including certain equivalent pension circumstances. A Seniors Card alone is not that eligibility test. The ACT Public Trustee and Guardian lists discounted preparation arrangements for eligible people with low means. These assistance schemes do not establish a national solicitor price.

NSW Financial Authority and Appointments

NSW financial appointments use the Powers of Attorney Act 2003 and the prescribed forms under the Powers of Attorney Regulation 2024. Schedule 2 distinguishes general Form 1 from enduring Form 2. The State Library’s official legal guide explains those forms and acceptance.

NSW Land Registry Services provides a general form and an enduring form. Use the form’s complete instructions when preparing a financial appointment. NSW Trustee and Guardian prepares documents through its advice service and does not supply blank forms itself.

An enduring appointment requires a prescribed witness who explains its effect and completes the certificate. NSW Government guidance identifies solicitors, barristers and Local Court registrars among the eligible witnesses. It also lists approved-course conveyancers and trustee employees, plus qualified overseas legal practitioners. Being a justice of the peace (JP) alone does not qualify someone to witness a NSW enduring appointment.

The attorney must sign acceptance before using an enduring power. That signature need not be witnessed or made at the principal’s signing. Check the commencement selection as well as acceptance.

Register the power with NSW Land Registry Services before using it for a relevant real-estate dealing. General account administration does not itself require land registration. A bank needs the appointment and identity evidence. A conveyancer also needs authority covering the dealing and the relevant registration details. If the document excludes the proposed act, institution acceptance cannot expand it.

Queensland Enduring Powers

A Queensland enduring power can authorise financial decisions under the Powers of Attorney Act 1998. Financial authority starts according to the document, which can specify immediate operation or a later circumstance. Personal powers have their own capacity-based rules.

The official Queensland forms collection contains free downloads and the Form 9 explanatory guide. Short Form 2 supports financial matters only, personal matters only or the same attorneys for both. Long Form 3 supports different attorneys for financial and personal matters.

The principal signs before an eligible JP, commissioner for declarations, lawyer or notary public. Apply the witness exclusions as well as the professional qualification. The witness must assess apparent understanding and voluntary signing. Each attorney must accept before acting. These requirements apply after downloading the form.

For Queensland land dealings, register the appointment using Titles Queensland’s Form 16, Request to register power of attorney/revocation of power of attorney. Lodge the required certified appointment copy. Queensland’s making-and-ending guidance explains this route. There is no general requirement to register every Queensland financial appointment.

A proposed transfer to the attorney, or purchase of the principal’s asset by the attorney, requires a conflict check. Identify the benefit and the competing duty. Under section 73, authority must cover the conflict transaction, its type or conflict transactions generally. Fair pricing alone does not supply missing authorisation. Keep the relevant clause or order beside the transaction record.

Victorian Enduring Powers

A Victorian enduring power under the Powers of Attorney Act 2014 can cover financial matters, personal matters or both. Read its commencement choice and restrictions before exercising financial authority. The principal must have capacity to make the appointment, and current capacity remains relevant to participation in decisions.

The Office of the Public Advocate directs readers to the Department of Justice and Community Safety’s official Victorian forms. The collection covers general non-enduring powers, enduring appointments and supportive appointments, including PDF forms. Select the instrument before completing it, then follow its signing and acceptance instructions.

An enduring appointment requires two adult witnesses. One must be authorised to witness affidavits or be a registered medical practitioner. A Victorian JP can satisfy the qualified-witness requirement, subject to the exclusions.

An appointed attorney or alternative attorney cannot witness the principal’s signature. Relatives of the principal or attorney are excluded. Care workers and accommodation providers for the principal are also excluded.

Keep the witnesses’ certificates and the attorney’s acceptance. The Office of the Public Advocate’s execution guidance explains these safeguards and commencement choices. For an individual Victorian attorney, an adult must also witness the acceptance signature.

A supportive attorney appointment helps the principal obtain information, communicate decisions or carry them out. The principal makes the decision. The appointment has no effect during a period when the principal lacks capacity for those matters. Its powers exclude giving effect to significant financial transactions such as selling a house.

A supportive appointment also needs two adult witnesses, including a qualified statutory-declaration witness. At least one must be independent of the specified family and care relationships. The supportive attorney’s acceptance needs an adult witness.

A general non-enduring power covers financial matters for its specified period or purpose while capacity remains. Medical-treatment decision-making requires the separate medical-treatment appointment or other applicable authority.

Managing Money Within the Authority

An attorney must apply the duties of the governing jurisdiction to each payment. Family agreement and bank access do not authorise a gift or remove a conflict.

In NSW, attorneys must act in the principal’s best interests and obey instructions. The prescribed forms distinguish authorised gifts and benefits to attorneys or others. Read the selected provisions and limits before transferring value.

Queensland applies its Act’s general principles and financial duties. Section 85 requires accurate records. Section 86 requires property separation, subject to joint-property exceptions. Gifts must meet section 88’s conditions and any document restrictions.

In Victoria, sections 63 to 69 address diligence, conflicts, records, gifts and separate property. Gifts must meet statutory conditions and document restrictions. Permitted conflict transactions have specific rules.

The Queensland Act and Victorian Act provide the jurisdiction-specific tests. Queensland’s attorney responsibilities guidance also explains financial records and property separation. Keep the principal’s funds in the appropriate account and record any applicable joint-property exception.

In a fictional example, an attorney pays the principal’s $180 electricity invoice under commenced financial authority. The invoice and account debit explain the authorised expense. Transferring $180 to the attorney as a birthday gift needs a separate gifts-and-benefits analysis. The amount alone does not decide legality.

Recording Authority With Institutions

Give each institution the appointment and its required identification. Retain the institution’s receipt, any commencement evidence and the account permissions it records.

InstitutionPublished administration requirements
ANZLodge an original or certified copy and identification at a branch. ANZ grants attorney access after branch identification.
WestpacBring the original or a copy certified by a lawyer or JP, plus identification. Supporting medical evidence can be required where capacity affects operation.
BankwestSupply a copy certified within six months and its Power of Attorney Details form. Additional identity checks can follow. The bank accepts general or enduring powers and also identifies administration orders as a separate authority.
OptusFor consumer and sole-trader accounts, supply the appointment, attorney identification and contact details, plus account-holder and service details through its stated submission process.

Bankwest’s details form records an existing appointment. It does not create a power of attorney. Optus also has a separate third-party-authority process for account holders who nominate someone. Record which authority is being used. An institution’s completed access process does not cure an invalid document or authorise an excluded transaction.

Establishing the Attorney’s Financial Record

Establish an opening inventory before reviewing ongoing attorney transactions. Record each account’s owner, balance and statement period, plus assets and liabilities relevant to the appointment. Record who controls access and when authority begins.

Keep the executed power and acceptance with commencement evidence, notices and any replacement appointment. For each payment, retain the source statement and receipt or invoice. Record the transaction’s purpose and any gift or conflict authorisation.

A working transaction ledger needs account identification, transaction date, description, debit or credit and running balance. Add the attorney’s explanation, supporting-document reference and authority for any exceptional payment. Preserve the original statement files alongside the ledger.

For each statement period, reconcile opening balance plus credits less debits to closing balance. Match transfers between supplied accounts so the same movement does not become apparent expenditure twice. Mark missing periods and unmatched transfers for follow-up. An unfamiliar withdrawal can be a permitted expense, reimbursement or transfer. Seek its evidence before classifying conduct.

FinTrace saves estate teams and forensic accountants hours of monotonous statement review by analysing the supplied PDFs and producing a searchable ledger and findings report. The report flags suspicious transactions and statement gaps, with source PDF filenames and pages giving direct access to the evidence. The service performs statement-analysis work at a fraction of the cost of manual review or engaging a forensic accountant for that work.

Where the evidence raises concerns, distinguish the authority question from investigating possible misuse of a power of attorney. Keep the financial record intact for that separate assessment.

WA, South Australia, Tasmania, ACT and NT Appointments

Financial appointments differ across these jurisdictions in their instruments, commencement and registration. Use the local preparation steps before relying on an interstate form.

JurisdictionInstrument and commencementPreparation and registration checks
Western AustraliaThe official enduring-power kit contains the free form. Select immediate continuation or operation following the required State Administrative Tribunal determination of incapacity.Complete the appointment and acceptance. Two independent adult witnesses attend signing. At least one must qualify to witness statutory declarations. A JP qualifies. General registration is unnecessary, but Landgate lodgement is needed before an attorney deals with land.
South AustraliaUse P1 for a general power or P2 for an enduring power. Select the enduring document’s financial commencement choice. Healthcare and personal planning use separate advance-care instruments. The Legal Services Commission kit explains completion. An authorised affidavit witness, including a lawyer or JP, witnesses the donor. Obtain the donee’s acceptance. Lodge the power with Land Services SA before a real-estate dealing.
TasmaniaOfficial form choices distinguish particular and general powers. Forms 3 and 4 are enduring. Read any commencement restriction. Two adult witnesses must be independent of the parties and their close relatives. Complete acceptance and use Form 5 to register with the Recorder of Titles. An enduring power cannot operate before registration, including for ordinary financial administration.
ACTThe Power to Choose guide and form covers property powers. Financial commencement can be immediate or conditional under the selected terms. Two adults witness together, with the principal present. One qualifies to witness statutory declarations. Only one can be a relative of the principal or attorney. Obtain attorney acceptance. Register an original for land dealings.
Northern TerritoryAn Advance Personal Plan replaces new enduring powers. Identify the appointed financial decision-maker and the circumstances in which substitute decisions become necessary.Complete the plan before capacity is lost and arrange an eligible witness, such as a JP, lawyer or health professional. Registration with the Public Guardian and Trustee is available free. Register the original at Land Titles, with its fee, if it appoints someone for land decisions.

For WA property work, Landgate’s enduring-power requirements require an original. Prepare two originals where appropriate. Lodgement beyond three months requires additional non-revocation evidence. A downloaded PDF alone cannot satisfy these steps.

South Australia’s official explanation distinguishes immediate financial operation from the selected incapacity condition. Its execution guidance requires a qualified witness and a donee’s signed acceptance. The acceptance does not need witnessing.

Tasmania’s Recorder of Titles factsheet confirms its broader registration requirement. In the ACT, official land-registration guidance identifies the original deed and retained-copy requirements.

For a temporary NT appointment while capacity remains, use the general-power form and witnessing instructions. Do not substitute that form for an Advance Personal Plan intended to support future incapacity.

Revoking a Power of Attorney

A principal with the required capacity can revoke an appointment using the governing jurisdiction’s process. An enduring power continues through incapacity, so loss of capacity does not itself permit the principal to sign a valid revocation. A general power ordinarily ends when the relevant capacity is lost.

In NSW, use the official revocation template or a properly expressed written notice. Identify the principal and appointment and state the revocation. The template permits an adult witness without a prescribed-witness qualification. Give the attorney notice and notify institutions holding the earlier power. Register the revocation if the earlier power is registered.

In Queensland, use official Form 6 for an enduring-power revocation. Follow its execution and eligible-witness requirements. Take all reasonable steps to notify every attorney. If the power is registered, lodge Form 16 with the revocation copy. General-power revocation uses Form 5, not the enduring revocation form.

Retain signed notices and proof of receipt by attorneys, banks and other relevant institutions. Obtain confirmation that attorney access is removed. Recover originals and copies where possible, identify them as revoked and preserve copies needed for the transaction history. Changing an online password alone does not revoke the legal appointment.

Replacing an attorney involves a new valid appointment or an existing replacement clause. Activating an appointment involves satisfying its commencement terms. Neither action can be assumed from a relative’s request. Check capacity, execution and notice before altering bank permissions. Record the point at which each authority starts or ends.

If capacity or validity is disputed, consider court or tribunal review of the power. Revocation stops future authority under the applicable rules. It does not recover money already transferred. Preserve evidence for any separate attorney compensation assessment.

Power of Attorney, Wills and Executor Authority

A financial power of attorney operates during the principal’s lifetime. A will directs estate administration after death. Being named executor does not itself permit someone to operate the living principal’s bank account.

An attorney cannot make or change the principal’s will through the power of attorney. A court-made statutory will follows a separate legal process and derives authority from the court. Appointment as attorney does not give that decision to the attorney.

Financial attorney authority ends at the principal’s death. Notify institutions and preserve the final pre-death balances and transaction records. Estate representatives must establish their authority under the will, probate or administration process before further withdrawals. Follow the institution’s deceased-estate document requirements. Keep attorney-period transactions separate from later estate administration so the representative can account for both.
