Enforcement Hearing: Prepare the Debtor’s Record

An enforcement hearing establishes a judgment debtor’s means through financial questions and recorded answers, informing the next supported recovery step.

An enforcement hearing establishes a judgment debtor’s means by requiring financial answers and documents through the court’s process. Prepare it around missing information, then reconcile the answers with the records before selecting a recovery method. The result is an evidenced account of what the debtor can pay and which assets need further investigation.

The walkthrough below concerns Queensland civil money orders. New South Wales uses a separate examination-notice and examination-order process. Use the procedure of the court handling enforcement, including any existing stay or instalment order.

What an Enforcement Hearing Establishes

An enforcement hearing gathers information about the debtor’s property and ability to satisfy an unpaid judgment. It does not decide the original claim again. Questions about a disputed liability belong in the appropriate challenge to the judgment.

In Queensland, the debtor can be questioned under oath or affirmation. The Queensland Courts enforcement-hearing guide explains the application and forms.

For comparison, the Legal Aid NSW examination-order guide describes seeking an examination order after non-compliance with an examination notice within 28 days. The NSW examination is usually an informal exchange, with the registrar involved if the debtor refuses to answer. Queensland forms and service options cannot be carried across to that process.

Check the Judgment and Preliminary Information

Confirm the order, correct debtor and unpaid balance before preparing the information request. Reconcile payments against principal, interest and recoverable costs. Record any registration required and any stay, insolvency restriction or existing payment order affecting the proposed step.

  1. Obtain the sealed judgment and identify the court responsible for enforcement.
  2. Send the Queensland preliminary written request with a blank Form 71 statement of financial position.
  3. Allow the 14-day response period after receipt, then assess the returned information.
  4. Identify precisely which answers or documents remain missing and why they matter to recovery.

A complete statement can make a hearing unnecessary. If the statement identifies a usable recovery route, consider that route’s requirements before incurring further hearing work. Keep the request, delivery record and response together so the application explains the information problem.

Prepare and Serve the Hearing Documents

Prepare the Queensland application so the requested documents match the financial questions you need answered. The court’s guide identifies Form 9 for the application, Form 46 for the affidavit and Form 70 for the summons, with Form 71 supplied.

  1. State the unpaid amount and explain the missing or unsatisfactory financial information in the affidavit. Follow the guide’s affidavit timing requirements.
  2. List the requested documents consistently in the application and proposed summons. Specify accounts and statement periods where known.
  3. Obtain the court-issued summons with its hearing time and place.
  4. Serve the summons at least 14 days before the hearing, using a permitted method. Retain evidence of what was served and when.
  5. Check the attendance location and conduct money before relying on service.

Queensland’s Uniform Civil Procedure Rules 1999, rules 807–816, govern this sequence. If practicable, the hearing must be in the district where the summoned person resides or carries on business. An application elsewhere requires a copy of the money order. Conduct money must be offered on service when the summons requires attendance outside that person’s district, with an undertaking in the supporting affidavit.

Check who is summoned, especially for a corporate debtor. The summons determines what must be produced and can require a financial statement at least four business days before the hearing. If adequate information later removes the need to attend, rule 813 provides for written notice to the person and court.

Build Questions From the Financial Gaps

Build each question from a missing answer, an unexplained transaction or a conflict between records. Request enough detail to distinguish ownership from access and income from a transfer between accounts.

A Fictional Incomplete Means Statement

Assume a debtor lists one bank account with $600 and declares wages of $1,800 a fortnight. Supplied statements show two transfers of $2,500 to an account ending 4821. The declared balance and wages are hypothetical, as are both transfers.

Financial gapFocused questionSupporting record
Destination account omittedWho holds account 4821, and what was each transfer for?Destination statements and account-holder details
Wages differ from depositsWhich deposits are wages, reimbursements or transfers?Payslips and the matching bank entries
Property listed without debtWhat is owed against the asset and who owns it?Ownership record and lender balance
Regular outgoing unexplainedIs this a liability payment or money moved between accounts?Contract or receiving-account statement

The $5,000 transferred is a lead to investigate. It does not establish that $5,000 remains available or that the debtor owns the receiving account. An answer that it belongs to a relative needs a recorded explanation and supporting documents, not an assumed classification.

Where supplied statements span many accounts, FinTrace removes the monotonous statement-review work and provides a searchable ledger. Its findings cite the source PDF filename and page, so the solicitor can place the relevant entry beside a focused question.

Record Answers and Deal With Missing Information

Record each answer alongside the question and document it explains. Follow the court’s procedure for preserving the examination record and obtaining any available recording or transcript. Distinguish the debtor’s explanation from your own inference.

Keep a document schedule showing what was requested, produced or still missing. If a new account emerges, record its holder and the evidence needed to establish its balance. A partial statement period remains partial after an oral explanation.

For non-attendance, first check service and receipt, the hearing details and any explanation. Under rule 816, the court can issue an arrest warrant when its receipt and insufficient-cause conditions are met. The creditor asks the court to exercise that power. A demand from a collection creditor alone cannot compel attendance.

Rule 815 permits the court to treat specified failures as contempt, subject to lawful excuse, including privilege. Put refusal to answer, missing documents or an unsatisfactory answer before the court for directions. A contradiction is a question to resolve, not an automatic finding of dishonesty.

Verify the Means Record and Select the Next Route

Verify the means record by tracing material answers to produced documents and keeping unresolved gaps visible. Compare the stated account balance with the statement’s closing balance and period. Match claimed wages to payslips and deposits, then separate recurring income from transfers and one-off receipts.

For each identified asset, record the claimed owner, supporting record, secured debt and unresolved ownership issue. Preserve inconsistent periods rather than extending an old balance to the hearing without evidence.

The finished record must distinguish confirmed means, explanations awaiting support and information still missing. That distinction guides the next application. Identified bank debts or earnings can lead to a garnishee order assessment under the applicable jurisdiction. Property requires a separate writ of execution assessment, including ownership and exemptions. A sustainable payment schedule can support an instalment order.

If the verified information reveals no immediately usable route, record that conclusion and the condition that would justify further recovery work. Keep the evidence obtained at the hearing ready for the particular application you choose.
