Exclusive Occupation of the Family Home

Who can remain in the home after separation? Prepare an exclusive occupation request or response with housing, household costs and practical order terms.

Exclusive occupation gives one separated party use of the family home, with an order restricting the other party’s occupation where the court considers that relief proper. For a family lawyer preparing or opposing the request, the evidence must explain why separate occupation is needed and how each household would function financially.

A workable proposal connects the legal basis to available accommodation, children’s circumstances and the costs that continue after someone leaves. Paying the mortgage alone does not decide who stays.

Separate Exclusive Occupation From Ownership

An exclusive occupation order addresses who can use the home while the matter continues. Registered title and final property division are separate questions. The order also does not create a residential tenancy entitlement.

Identify the property, the person seeking occupation and the person to be restrained. Specify the proposed start, duration or review event. Distinguish a request to vacate from a restriction on returning, entering the grounds or using a particular part of the property.

Incorrect: A client files an application and treats the requested exclusion as already binding. Correct: The lawyer identifies the existing legal authority before advising what the client can do. A filed application or proposed arrangement alone gives neither party a court-ordered right to exclude the other.

Keep the interim request separate from arguments about who ultimately receives the home. A party can obtain temporary occupation without securing the property at settlement.

Check the Family-Law Route and Existing Orders

Select the occupation power for the relationship and court before drafting the application or response. The following routes distinguish federal proceedings from the Western Australian example.

MatterCourt routeOccupation power and jurisdiction check
Married parties under the Family Law ActFederal family-law jurisdiction, including its exercise in WASection 114(1)(b) permits a restraint on entering or remaining in the matrimonial home. Section 114(1)(f) addresses its use or occupancy.
De facto parties under the federal financial jurisdictionFederal route in participating jurisdictionsSection 114(2A) expressly addresses occupation and related restraints. Its relationship and geographical conditions include sections 90SB and 90SK.
WA de facto matterFamily Court of Western Australia under state lawSection 235A(1)(b) and (d) of the Family Court Act 1997 addresses exclusion and occupation. Establish the applicable WA jurisdiction.

The Family Law Act gives the federal court a discretion to grant relief it considers proper. Section 90SS contains general financial powers. Use the express occupation provision when identifying the legal basis.

Legal Aid WA’s practitioner handbook describes the occupation inquiry as objective and fact dependent. Assess whether exclusive occupation is necessary, then which party ought to occupy. Its discussion of Elliot & Hopkins (No 2) [2023] FedCFamC1A 142 explains the fair, just and reasonable assessment. Mere inconvenience is insufficient. Evidence can address whether continued shared occupation is reasonable or practicable, each party’s resources, conduct and resulting hardship, including effects on children.

For WA proceedings, the Family Court’s legislation guide distinguishes married-party matters under Commonwealth law from de facto property matters under WA law. Check jurisdictional thresholds and time limits before selecting forms.

Obtain every existing parenting, occupation and personal-protection order, including any police or family-violence order. Compare protected people, premises, exceptions and expiry terms. Section 114AB also requires attention to prescribed state or territory proceedings concerning the same matter. Do not assume one order cancels another. The responsible lawyer must resolve any conflict and urgent safety issue before proposing access or handover.

Prepare the Housing and Household Cash-Flow Record

Prepare a separate accommodation and cash-flow record for each party, while counting shared obligations only once in the combined budget. Record the children’s living arrangements where relevant, school travel and care responsibilities. Identify any accommodation offered by relatives and whether it is actually available for the proposed period.

Use lawfully supplied bank statements, loan statements and bills to establish recurring payments. Keep a source reference beside each total. Separate transfers between the parties’ own accounts from income, and separate a one-off removal expense from ongoing rent.

A rental advertisement supports an asking rent, not an accepted tenancy. Record the proposed bond, advance rent and moving costs separately. Show whose funds would meet them and when those funds become available.

Hypothetical Two-Household Budget

Suppose Parent A proposes to remain with the children in the mortgaged home and Parent B would rent elsewhere. Both remain borrowers. All figures below are hypothetical monthly cash amounts. The assumed household allocation must be assessed against the children’s actual living arrangements.

Monthly itemParent A in the homeParent B rentingBasis
Net income$4,200$6,000Assumed payslips and matching salary credits
Joint mortgage payment, allocated once to A$3,000$0Assumed loan statement
Home utilities, rates and insurance allowance$600$0Assumed bills, converted to monthly amounts
Alternative rent$0$2,400Estimate from a suitable rental listing
Alternative utilities$0$250Estimate
Living, transport and care costs$1,700$1,500Assumed spending record and proposed care arrangements
Total outgoings$5,300$4,150Sum of the stated monthly items
Income less outgoings-$1,100$1,850Monthly cash position before any support transfer

The proposal leaves A short by $1,100 each month. B’s apparent $1,850 surplus does not itself establish a support obligation or an available rent tenancy. If B agrees to transfer $1,100 monthly, A reaches zero and B retains $750. Count that payment as an internal transfer when calculating the combined position, so total income remains $10,200.

Assume B also needs $3,000 for bond, advance rent and moving costs. That is a separate opening cash requirement. The monthly surplus does not establish that B has $3,000 available at handover. Evidence of accessible savings, an agreed funding arrangement or another supported proposal must address the gap.

Compare the alternative arrangement if B stays and A moves. Include suitable housing for the children during their time with each parent. Greater income and payment of the mortgage are relevant financial facts, but neither automatically determines occupation.

FinTrace saves hours of statement conversion and review when you need to establish the household spending record. Each finding identifies its source PDF filename and page, putting the supporting evidence beside the analysis.

Present the Application or the Opposition

Present facts that address the occupation discretion and the effects of the proposed arrangement on both parties. Organise the affidavit around the current living situation, relevant conduct and available alternatives. Explain the source of each factual assertion and identify disputed accounts of events.

For an applicant, connect the requested exclusion to the evidence that makes it necessary. For a respondent, address that necessity directly and give evidence of the hardship or practical problems the proposed terms would cause. If a different arrangement is proposed, show how it would work. Include contrary evidence, such as accommodation your client could use or a payment history that differs from their instructions.

The cash-flow schedule supports the financial facts. The affidavit explains those facts and their effect on the people concerned. Your legal submission applies the occupation power and authorities. A statement-analysis report or an unsupported assertion of hardship cannot supply that legal argument.

Federal Filing and Notice

Use the Court’s application guidance to select an Initiating Application for new proceedings or an Application in a Proceeding for an existing case. Seek the occupation relief expressly and file the supporting affidavit. For agreed relief, select the consent route appropriate to the proceeding.

Under the financial proceedings practice direction, check pre-action requirements and the documents required for the case. An urgent request requires the relevant application, supporting affidavit and a cover letter identifying the evidence of urgency. Seeking an urgent listing does not establish that the order will be made.

Confirm filing and service deadlines against the Family Law Rules and case directions. A respondent opposing an Application in a Proceeding files and serves the corresponding response and affidavit. Check affidavit length and annexure limits. Without-notice relief requires separate justification under rule 5.11, including why an early hearing after shortened service would be unsuitable. Address adverse facts and the respondent’s likely hardship.

WA Filing Example

In WA, the property application procedure uses Form 1 with the applicable financial statement and supporting affidavit. In an existing case, an Application in a Case uses Form 2. The responding form is Form 2A.

Check the applicable standard or simplified case documents, conferral requirement and any supported urgency exemption. Arrange the required service and retain proof. Use WA rules and registry directions for the hearing, rather than importing the federal filing process.

Propose Workable Possession and Payment Terms

Draft terms that let each party identify what they must do at handover and throughout the occupation period. The proposed terms need to address the following matters.

  • Identify the home precisely and name the people whose occupation or access is affected.
  • Specify when occupation starts, when the other party must leave and the period or event that ends or reviews the arrangement.
  • Define permitted collection of belongings, access for repairs and any other exceptions. Set a workable handover method consistent with protection orders.
  • Allocate mortgage or rent, utilities and other continuing payments. State the amount or calculation, payment destination and timing.
  • Set how parties exchange payment records, report arrears and raise a changed circumstance requiring review.

Keep occupation, payment allocation and the loan contract separate. An obligation between the parties to meet mortgage payments does not itself release either borrower or rewrite the lender’s contractual rights. Identify any separate lender consent or legal relief that the proposal needs.

For the hypothetical budget, an agreed $1,100 transfer needs a payment method and timing that puts funds in the account before the mortgage falls due. Record how the parties will confirm receipt. A term allocating the mortgage to A must also explain the funding arrangement that makes that allocation possible.

Verify the Result and Review Changed Circumstances

Read the entered order or signed agreement before advising the client to act. Identify its legal effect, operative time, service requirements and access exceptions. Confirm the actual terms against the proposal, including any change the court makes at the hearing.

If the result leaves an ambiguity about collecting belongings, seek clarification through the proper process before arranging entry. If a payment is missed, compare the bank record with the amount and due time in the order. A shortfall in the budget calls for investigation of its cause and any appropriate review or enforcement step.

Record housing payments and changes in accommodation, income or the children’s arrangements. Reconcile actual expenditure with the interim budget before seeking a variation. Preserve the evidence of who paid each outgoing for later consideration, while keeping interim affordability separate from the final treatment of contributions or occupation benefits.

The completed file must identify who is authorised to occupy, which payments continue and whether the supported cash-flow position funds those payments. Record the next review event and the evidence needed if circumstances change.
