Legal Research: Sources, Methods and Verification

Build a legal research method that connects Australian authorities to a checked matter note, with source selection, citation checks and AI limits.

Legal research means finding, checking and applying legal sources to a defined issue. For an Australian matter, start with the jurisdiction and facts, then connect each proposition in your research note to an authority you have read. Keep the evidence supporting the facts alongside that legal trail.

This method suits solicitors, legal researchers and supervised paralegals preparing advice or submissions. Before searching, confirm your instructions, the relevant period and access to the necessary sources. Keep confidential matter material within systems your firm has approved.

Frame the Issue and Choose a Research Method

Turn the client’s problem into a question that identifies the legal issue and the facts that could change the answer. “Research insolvency” is too broad. “What evidence is needed to assess whether this company could meet its debts when they fell due?” gives the researcher a starting point.

Record the entity, forum and relevant period. Separate confirmed facts from instructions and assumptions. A company’s position, an individual’s bankruptcy and an estate’s administration require different sources even when each involves unpaid debts.

Doctrinal legal research examines legislation and judgments to establish the applicable law. Empirical research examines observations or data, such as a study of how disputes resolve. Socio-legal research considers how law operates within social or institutional conditions. The latter methods can inform policy arguments or an understanding of client experience. A study of outcomes does not establish the legal test governing an individual matter.

Use the following sequence for a matter file.

  1. Write the question and identify the jurisdiction.
  2. Find the governing legislation and candidate cases.
  3. Check the original sources and their subsequent treatment.
  4. Apply the supported propositions to the evidenced facts.
  5. Record the unresolved questions for the supervising lawyer.

The expected result is a note another practitioner can follow without repeating the entire search.

Select legal research tools by the authorities you need to retrieve and check. Compare Australian jurisdiction coverage, the earliest material held and the way each collection updates. Confirm that your access includes the full text behind a search result.

Match the Resource to the Research Job

LexisNexis describes CaseBase as part of Lexis+ Australia’s research platform. Thomson Reuters’ Westlaw Australia guide explains how KeyCite lists citing references and distinguishes levels of discussion. Read the later judgment itself to determine what its treatment means for your proposition.

A small firm can combine official sources with a public case database, then obtain specialist access for a missing report or commentary. Library membership and access conditions determine what you can obtain through a professional library. A premium subscription earns its place when its content or citator functions solve a recurring gap in the firm’s work.

Evaluate legal research software by whether you can retain the citation, pinpoint passage and source version in an exportable note. A database subscription supplies access to a defined collection. A summarising tool may only process material retrieved from elsewhere. A fluent answer does not establish access to Australian authority or a complete research trail.

Find Cases, Legislation and Practical Guidance

Search from the legal issue to the underlying authority, then preserve a stable reference. Commentary and practical guidance help you identify terminology and candidate provisions. The source supporting a legal proposition remains the legislation or judgment itself.

For example, a question about recipient liability may lead to Farah Constructions Pty Ltd v Say-Dee Pty Ltd [2007] HCA 22. Use the High Court’s judgment page to confirm the case identity and open the judgment. Read the passages addressing your issue, then record their paragraph numbers. The catchwords identify topics covered. They do not supply the reasoning needed to apply the decision.

For a statutory question, search the official legislation register by the Act’s title or provision. Open the version relevant to the events and read the definitions as well as the operative section. The Federal Register explains how to select the appropriate legislative version using compilation periods and amendment notes.

Keep binding authority distinct from persuasive authority and explanatory material. Court hierarchy, jurisdiction and the point actually decided determine a case’s authority. A practical checklist can help you prepare a task, but its wording does not replace the applicable rule or practice note.

Check Citations, Currency and Subsequent Treatment

Open every primary authority supporting the proposed advice and check the proposition against the text. For a quotation, compare the words and pinpoint reference with the judgment. Read the surrounding reasoning for qualifications or a different factual setting.

  1. Confirm the parties, court and citation match the intended decision.
  2. Check the procedural history, including any appeal or later order.
  3. Use a citator to find later cases considering the relevant proposition.
  4. Read adverse treatment and any later appellate discussion in context.
  5. Check the statutory version, commencement and transitional provisions relevant to the matter.
  6. Save the source reference and record who performed the check.

A citator signal is a route into the later material. A case can receive adverse treatment on one point while another passage remains useful. Where paid access is unavailable, search later official judgments for the citation and inspect accessible citing references. Record an unresolved coverage gap in the matter note and obtain the missing source before advising on the affected proposition.

Consider this fictional insolvency enquiry. A company statement shows $18,000 available in one account, while invoices appear to require $30,000 in payments during the following week. A director’s email says an unused $50,000 facility was available. The facility agreement has not been supplied.

The legal-source entry identifies section 95A of the Corporations Act 2001. In paraphrase, its solvency test concerns the ability to pay all debts as they become due and payable. The research note must then identify relevant case law on the resources available to meet those debts.

The fact-source entry reads, “Company-account.pdf, PDF page 4, shows a closing balance of $18,000.” A separate entry cites “Unpaid-invoices.pdf, PDF pages 2 to 6” for the payment amounts and terms. The director’s email supplies a competing factual account of available funding.

The unresolved question is whether that funding was available on the required terms and at the required time. The supervising lawyer decides the legal significance after obtaining the facility documents and necessary specialist input. The statement balance remains a checked financial fact throughout.

Use AI for Research Without Delegating Verification

Use AI to suggest search language or identify candidate authorities, then verify each candidate through the original source. Keep the prompt limited to the approved research environment and use anonymised facts where confidential details are unnecessary.

A useful first prompt is, “For an Australian corporate insolvency issue, suggest search terms about available credit and payment of debts. Separate legislation from cases and provide source links.”

For a second pass, ask, “Using only the authorities supplied, identify passages supporting the proposition and passages that limit it. Give paragraph references and identify any contrary authority cited.” Read those passages yourself. An instruction to provide links cannot prevent a fabricated citation or an unsupported summary.

The Federal Court’s AI practice note expects the responsible person to confirm that cited legal authorities exist and support the stated proposition. Its requirements also address evidence and disclosure in particular circumstances. Apply the rules of the court handling the matter.

The Supreme Court of Victoria’s AI practice note explains why asking another AI tool to confirm an answer is insufficient verification. Inspect the original source material. When an answer supplies overseas authorities, search the Australian jurisdiction again before adopting its proposition. For assistant selection, the separate guide to legal AI tools addresses that decision.

Research Specialist Material for the Matter

Choose specialist material according to the question requiring an answer. Medico-legal authority research establishes the legal rules for a matter. Medical literature can explain a condition or an evidence base. A clinical opinion applies professional medical expertise to an individual’s circumstances. Finding an article about symptoms cannot establish that individual’s diagnosis.

In a fictional estate dispute, a beneficiary questions whether a deceased person understood a financial transaction. Identify the applicable succession or transaction issue and state jurisdiction first. Research the relevant legal test separately from the medical records. Put questions about the person’s clinical condition to an appropriately qualified expert, with the records and assumptions identified.

For an employment-law enquiry, establish the employer’s legal identity before searching for an award entitlement. Western Australia has state and national employment systems, with coverage depending on the employer’s structure. For a national-system matter, identify any applicable agreement and the relevant award coverage and classification. Read the instrument covering the work and period under review before calculating an entitlement.

Use Insolvency Books as Research Leads

Keay’s Insolvency: Personal & Corporate Law and Practice addresses Australian personal and corporate insolvency. Thomson Reuters lists an 11th edition, published in 2022. Its discussion can help identify statutory provisions and cases across the two regimes. Read the edition details of the copy you use and return to the applicable Act and Rules for the operative requirements.

Assaf’s Winding Up in Insolvency by Farid Assaf SC is a more focused Australian research lead for statutory demands and winding-up applications. The High Court library’s acquisitions list records the third edition, published by LexisNexis Australia in 2021. That edition is a historical research source, not a statement that its contents reflect every later development.

If you find a passage in Assaf’s third edition, record its paragraph and the provision it discusses. Compare the provision with the version governing the matter. Follow amendments through commencement and transitional provisions, then note up the cited cases. Apply the same process to an older Keay’s edition. A familiar textbook explanation does not establish that a procedure remains available on identical terms.

Write a Source-Linked Research Note

Write the research note so the reviewing lawyer can move from the question to the supporting sources and the unresolved decision. Use the following fields as a working structure.

  • State the issue, jurisdiction and purpose of the note.
  • Identify the confirmed facts, assumptions and documents still needed.
  • List the governing provisions and cases, with version and pinpoint references.
  • Explain each supported proposition and any contrary authority.
  • Apply those propositions to the facts, keeping alternative explanations visible.
  • Record unresolved questions, proposed next steps and the reviewer’s decision.

In the fictional insolvency enquiry, keep the $18,000 balance beside its statement reference. Keep the claimed $50,000 facility beside the director’s email and the outstanding document request. The legal analysis explains why access to that funding could affect the answer. It must preserve the difference between a documented balance and an unconfirmed funding assertion.

When the matter contains substantial bank records, FinTrace saves hours of statement review by delivering analysis with direct source references. Lawyers and forensic accountants receive a searchable Excel ledger and a findings report, with each finding citing its PDF filename and page. That keeps the financial evidence at hand while the practitioner develops the legal analysis. The guide to bank statements as evidence covers the underlying records.

Delegate Research and Review the Result

Give a paralegal a bounded question, the permitted source scope and a defined output. For the fictional company enquiry, assign research on section 95A and authorities about available funding. Request a short note identifying the relevant passages and any contrary treatment, with a separate list of missing financial documents.

Specify the reporting deadline and the point at which the researcher must escalate. A missing judgment, conflicting appellate decisions or an uncertain jurisdiction belongs with the supervising lawyer. A paralegal must not resolve a substantive advice question merely to complete the task.

Record the researcher’s name and the sources they checked. The supervising lawyer records the legal conclusion approved and any further work required. If the firm commissions external support, legal process outsourcing raises the separate supervision and engagement questions.

Develop Research Skills Around Real Work

Choose training by the part of the research process that failed. Repeated irrelevant results call for work on issue framing and search syntax. Missed adverse treatment calls for citator training. A note full of copied extracts needs practice in stating propositions and applying them to facts.

A legal research course or legal writing workshop is useful when its exercises match that gap. Use an anonymised completed matter to compare the researcher’s first note with the reviewed version. Identify what changed the answer and what merely improved presentation.

Check any claimed continuing professional development recognition against the rules applying to your practising certificate and the relevant professional body’s requirements. The Law Society of NSW’s CPD guidance sets out its categories and record requirements. A provider’s course label alone does not establish compliance elsewhere.

Before signing off the next matter note, reopen a supporting authority and follow its pinpoint reference. Confirm that the proposition survives the surrounding text and subsequent treatment, then check that the facts supporting its application have their own source trail. Escalate any unresolved point before the affected advice goes out.
