Power of Attorney for Dubai Property Sale
Selling Dubai property through an attorney? Check the sale authority, Australian document authentication and the trail of settlement proceeds.

A power of attorney for a Dubai property sale must authorise the sale and meet Dubai Land Department’s requirements for the document’s use. For an Australian-based owner, resolve the execution and attestation route before signing, then account separately for every payment from the sale.
The authority to transfer title and the evidence showing where the money went answer different questions. An estate solicitor or investigator needs both records when an attorney’s handling of the property is disputed.
Sale Authority and Permitted Acts
Check the proposed sale against the actual powers granted to the attorney. Dubai Land Department’s guidance allows a representative to deal with property within the limits stated in a duly legalised power of attorney.
Read the complete document, including schedules and amendments. Build a short authority checklist against the proposed transaction.
| Document detail | What to compare with the sale | Question to resolve before completion |
|---|---|---|
| Principal and attorney | Passport details and names used in the transaction | Is the person signing the appointed attorney for this owner? |
| Property and ownership share | Title deed, unit details and registered owner | Does the authority cover this property and the interest being sold? |
| Sale powers | Contract signing, transfer documents and registration acts | Does the wording authorise the acts the attorney will perform? |
| Limits and conditions | Minimum price, consent conditions and permitted buyer | Does the proposed sale satisfy every applicable restriction? |
| Payment powers | Approved payee, account instructions and receipt wording | Who may collect payment, and where must it go? |
| Substitution | Any appointment of a further representative | Does the document permit delegation, and is the later appointment evidenced? |
Permission to collect rent or manage repairs does not establish permission to sell. Locate the sale wording itself. Likewise, keep the power to sign transfer documents separate from any wording about collecting or banking the proceeds.
DLD’s published property sales contract provides for the balance by manager’s cheque payable to the seller, or another guaranteed payment method acceptable to DLD. Obtain transaction-specific confirmation of the permitted payment arrangement before treating an attorney’s receipt clause as sufficient authority for a different payee.
Keep that confirmation with the payment instructions. A last-minute change from the owner’s account to a relative’s account needs its own explanation and supporting authority.
Execution, Authentication and Dubai Acceptance
For an Australian-signed power of attorney, arrange notarisation and the required Australian and UAE attestations before presenting it for the Dubai sale. DLD’s overseas-document guidance identifies the notary, the originating country’s foreign affairs authority, the UAE embassy and UAE foreign affairs stages.
Use this sequence to prepare the file.
- Send the proposed wording and title details to the receiving DLD registration trustee before execution. Obtain the required property description, sale powers and payment wording in writing. Record which originals or verifiable digital documents must be presented.
- Arrange Australian execution through the accepted notarial route. The UAE Embassy in Canberra instructs that powers of attorney be signed before a local notary or legal authority, then attested by Australia’s Department of Foreign Affairs and Trade (DFAT).
- Complete DFAT legalisation using the certificate required for the receiving authority’s route. DFAT’s instructions require confirmation of whether an authentication certificate or apostille is needed. Keep the certificate attached to the document it authenticates.
- Complete the UAE attestation stages. Canberra’s digital service combines embassy and UAE Ministry of Foreign Affairs attestation in one application. It requires UAE Pass sign-in and collection of the physical original, with digitally attested documents returned by email.
- Resolve Arabic translation and final presentation requirements with the receiving authority. The Dubai Courts electronic notary guidance requires legal Arabic translations for documents used in that process. Have the accepted translator work from the complete executed and attested document, including its certificates.
At the final checkpoint, the file must identify the accepted document version and show completion of the required attestations. Keep the translation beside its source document so a reviewer can compare the property and powers across both.
Dubai Courts also publishes an electronic notary route with identity and eligibility checks, document submission and virtual or personal attendance. Confirm the principal’s eligibility and acceptance of the resulting document for this sale before choosing it instead of Australian execution. An online application alone does not establish that the principal can complete every required stage remotely.

Following the Settlement Proceeds
Reconcile the contract price to the settlement payments, then follow the net proceeds through the receiving accounts. Preserve the executed authority and title details alongside the sale contract, settlement record and bank statements.
Request evidence for every deduction. A mortgage payout needs the lender’s discharge figure and evidence of payment. Fees or adjustments need the relevant invoice or settlement entry. Match each destination to its account holder and the approved payment instructions.
The following fictional reconciliation uses UAE dirhams. The deductions are invented transaction amounts, not prescribed fees.
| Settlement item | Amount | Evidence to match |
|---|---|---|
| Gross sale price | AED 2,000,000 | Executed sale contract and settlement record |
| Mortgage payout | AED 600,000 | Lender payout statement and payment record |
| Documented sale costs and adjustments | AED 50,000 | Invoices and settlement breakdown |
| Net proceeds due to the owner | AED 1,350,000 | Gross price less the two deductions |
| Credit to the owner’s account | AED 1,300,000 | Receiving bank statement |
| Difference requiring explanation | AED 50,000 | Payment instruction, cheque or transfer evidence still to obtain |
In this example, the documented deductions explain AED 650,000 of the price. The owner’s credit leaves AED 50,000 to reconcile. Record that difference as unexplained until further evidence identifies a supported deduction or another payment.
If the attorney says the balance went to a second account, obtain that account’s statement and the instruction authorising the destination. A transfer receipt records a payment instruction. The receiving statement establishes the credit shown in that account.
Continue the chronology after receipt. For a later transfer to Australia, retain the foreign-exchange confirmation, sending debit and receiving credit. Compare the actual currencies, charges and settlement interval. Avoid treating unlike currency amounts as a shortfall without that evidence.
FinTrace saves estate teams and forensic accountants hours of statement review by following transfers across supplied accounts and currencies. The service provides a searchable ledger and a clear findings report, with each finding citing its source PDF filename and page. That gives the professional direct access to the evidence behind the settlement chronology.
An unexpected recipient or rapid onward transfer is a reason to seek supporting records. It does not, by itself, establish misuse of the authority or ownership of the money.
Revocation, Expiry and Disputed Authority
Check that the authority remains operative when the sale documents are signed and when the payment instructions are acted on. DLD’s FAQ states a two-year validity period for powers used for sale transactions. Compare the notarisation record with the intended transaction timing and check any earlier expiry or limiting condition in the document.
Record the result of the authority check at each stage. If completion is delayed, repeat the check against the new timing. Keep any cancellation document, issuing reference and evidence of receipt by the people handling the sale.
DLD’s power of attorney cancellation service lists an in-person process at its main headquarters. It requests identity copies for the principal and attorney, or valid passports for non-resident foreigners. Use the relevant issuing and receiving authorities to establish the cancellation steps for the particular document.
For a contested revocation, record who received notice, what they received and when. Preserve acknowledgements from the attorney and the registration trustee, together with any bank or buyer correspondence. Those records let the legal adviser assess the effect of notice against the sequence of signing, registration and payment.
Where execution or scope is disputed, retain the original document and its notarial record. Preserve all versions of the translation, the attestation verifications and the instructions supplied to the attorney. Keep messages about price approval and changes to the payee with the signed sale documents.
Where receipt of proceeds is disputed, preserve statements covering the period before settlement through the later transfers in issue. Add cheque images, remittance records and any records identifying the receiving account holder. Keep missing periods visible in the chronology.
Finish the file with two separate schedules. One maps each disputed act to the authority relied on and the evidence about its status. The other reconciles the sale price to documented deductions, actual receipts and onward payments, with each unexplained amount tied to the next record required.
