Separation: Dates, Financial Records and First Steps
Separation under one roof can still end a relationship. Record what changed, preserve financial evidence and distinguish divorce from property claims.

Separation happens when a relationship ends, even if the parties continue sharing a home or paying joint expenses. For a family lawyer, the first task is to establish what changed and when, then preserve the records supporting that account.
A bank statement can show a new rent payment or continued mortgage support. The client’s instructions and surrounding evidence explain what those payments mean for the separation chronology.
What Separation Means in Family Law
Separation concerns the end of the relationship. Divorce formally ends a marriage, while property settlement determines financial arrangements between former partners. Each involves a different task and different evidence.
In Australia, clients do not file for separation or obtain separation papers to make the relationship end. The Family Court of Western Australia’s separation guidance explains the need to communicate the decision to the other person. Both parties do not have to agree.
Ask who decided the relationship was over, how that decision was communicated and what changed afterwards. A separate bank account is evidence of financial arrangements, not a legal test for separation.
Under sections 48 and 49 of the Family Law Act 1975, spouses can separate through one party’s conduct and remain in the same residence. Divorce requires the statutory separation period of at least 12 months and no reasonable likelihood of resumed cohabitation.
Clients sometimes call an arrangement a trial separation or temporary separation. Those labels do not establish whether the relationship ended. Record whether the parties intended only a short break or had ended their relationship, together with the conduct supporting those instructions.
Keep the later divorce application separate from the immediate task of recording separation. A de facto couple does not need a divorce to end their relationship.
Agreeing or Disputing the Separation Date
Establish a chronology from the client’s instructions before asking financial records to corroborate it. If the parties give different dates, preserve both accounts and identify the facts behind each.
Record the following information in the file:
- The words used to communicate separation, including messages or emails still held.
- Changes in bedrooms, meals, household work and social activities.
- Who was told, what they personally observed and whether they can give evidence.
- Any move, lease commencement or change of address.
- Financial arrangements before and after the proposed date.
- Any attempt to reconcile and the circumstances of a later separation.
A continuing joint mortgage payment can reflect housing needs after separation. A stopped transfer can reflect a banking change before separation. Ask for the explanation before treating either as evidence of the relationship’s end.
For divorce, section 50 permits aggregation of separation periods after one resumption of cohabitation followed by separation within three months. The reconciliation period itself does not count. Record the actual events and apply the statutory conditions, rather than assuming every reconciliation preserves the original date.
Once the chronology is established, identify the relevant family law time limits for the relationship and proceeding. Avoid importing a divorce timetable into a property claim.
Separation Under One Roof
Separation under one roof requires evidence that the relationship changed despite the shared address. Explain why the parties remained together physically, including accommodation costs or arrangements for children.
For a divorce in the Federal Circuit and Family Court of Australia (FCFCOA), use the under-one-roof factsheet. It identifies changed sleeping arrangements, reduced shared activities, household duties and financial arrangements. Record what family and friends knew, arrangements for children under 18 and relevant government correspondence.
The divorce practice direction requires affidavit evidence where the parties lived separately under one roof during the preceding 12 months. For a sole application, the factsheet requires the applicant’s affidavit and recommends an independent person’s affidavit. Joint applicants must each file a separate affidavit. If only one can do so, the factsheet recommends independent evidence.
Western Australia has a different filing requirement. The Family Court of Western Australia requires an independent person’s affidavit for both sole and joint under-one-roof applications. A joint application also needs separate affidavits from each spouse. WA divorce applications use that Court’s process.
Centrelink assesses relationship status for social-security purposes separately. A court affidavit does not replace its forms, and a benefit decision does not automatically establish the separation date for divorce.
Centrelink Separation Forms and Proof
The relationship-separation form is Separation details, MOD S. The Employment Separation Certificate, SU001, concerns employment information supplied by an employer. It is not a form for ending a relationship.
Some clients can report separation online instead of using MOD S. Where the form is needed, download it from Services Australia and follow its question routing. The client must sign it and provide the documents requested for their circumstances. Services Australia says the ex-partner does not need to complete a part of MOD S.
The form asks for personal and contact details, the separation date, the ex-partner’s details and current living arrangements. It also asks about possible reconciliation. Depending on the answers, supporting documents include a signed lease or records verifying a property sale. It asks for an eligible adult referee who knows the relationship circumstances, or an explanation if none can be provided.
Upload the signed form and supporting documents through a Centrelink online account linked to myGov or the Express Plus Centrelink app. A service centre or post is available when uploading is not possible.
Clients living with their ex-partner also use Relationship details: Separated under one roof, SS293. Each normally completes a separate form. Services Australia makes an exception where obtaining the ex-partner’s form puts the client at risk.
If separation is disputed, explain the disagreement and supply the client’s factual account. Preserve supporting communications and any request for further evidence. Raise safety concerns directly with Services Australia instead of asking the client to obtain an unsafe signature.
A request for a “Centrelink separation allowance” needs clarification of the payment sought. Separation can affect an existing payment or lead to an assessment for another payment. Use Services Australia’s separated-parent information to identify the relevant route. Services Australia determines eligibility and the amount, including the effect of income and care arrangements.
Separation Checklist and Immediate Finances
Use a separation checklist to preserve information and organise immediate household decisions. An amicable separation still needs a record of what each party agrees to pay and how long that arrangement lasts.
The following marriage separation checklist is a printable working sheet. Print this section or save it as a PDF using the browser’s print controls. Add the client’s name, completion date and responsible person before using it.
| Done | Action | Record or decision to retain |
|---|---|---|
| Record the proposed separation date and any dispute | Instructions, communications and witness details | |
| Secure safe accommodation and a reliable contact method | Immediate housing plan and safe address for correspondence | |
| Preserve statements for every known account | Original PDFs, account list and missing-period list | |
| List debts and upcoming payments | Mortgages, cards, loans and due amounts | |
| Review account authorities with the bank and lawyer | Signatories, cards, overdrafts and notification settings | |
| Identify recurring household payments | Rent, mortgage, insurance, utilities and child-related expenses | |
| Record interim payment arrangements | Who pays each expense, source of funds and review point | |
| Make safe copies of financial documents | Accessible storage separate from a shared device where needed | |
| Update safe contact and access arrangements | Personal email, passwords and authorised representatives | |
| Arrange advice on unresolved decisions | Housing, support, children or preservation concerns |
For a client-specific working document, the browser’s separation checklist template records selected tasks and financial records to collect. You can edit tasks, mark missing documents and record who will follow up before downloading a printable copy. Keep this article’s short checklist for the first conversation, then use the template to track the client’s own outstanding work.
Who pays the mortgage after separation starts with the loan contract. Legal Aid NSW’s mortgage guidance explains that joint borrowers remain responsible for the whole loan even if one moves out. Record an interim payment arrangement or any court order, and address unaffordable repayments with the lender promptly.
An arrangement between partners does not itself release a borrower from the lender’s contract. Keep statements showing each payment and its source. The eventual property settlement assesses those payments in context. Making them does not decide ownership or guarantee reimbursement.
Reviewing an account authority does not mean emptying or closing a joint account. Obtain advice on the proposed change and its effect on payments before acting. Preserve the starting balances and any written agreement about access.
An informal expense agreement records interim conduct. It does not, by itself, finalise property rights. Keep formal settlement work with the lawyer advising on property division.
Marriage, Families and Separation Brochure
The official Marriage, families and separation brochure explains separation services, legal processes and ways to reach agreement. Clients can read it online or download the Court’s PDF.
Section 12E of the Family Law Act requires a lawyer consulted about contemplated proceedings to provide prescribed information, subject to the statutory exceptions. Provide the relevant brochure during that advice and explain the parts affecting the client’s next decision. Record that it was given. For a sole divorce application, the brochure is also among the documents served on the other spouse. WA’s divorce application guidance likewise identifies the brochure for service.
The brochure provides general information. A separation checklist organises practical tasks. A formal financial settlement needs the appropriate legal document, such as consent orders or a binding financial agreement. Neither the brochure nor a completed checklist records a final division of property.
Building the Financial Separation Chronology
Build the financial chronology around identified events, with a source for each observation and a separate explanation of its limits. The following example is fictional. All periods run from the client’s asserted separation event.
| Point in chronology | Source reference | Observation | What it can and cannot show |
|---|---|---|---|
| Separation event | Message export, item 12 | One party communicates that the relationship has ended | Records the communication; its context and authenticity still matter |
| Two weeks later | Joint-account.pdf, page 3 | The usual household transfer stops | Supports a changed payment pattern; does not establish why it stopped |
| Four weeks later | Personal-account.pdf, page 2; lease, clause 2 | Bond and rent payments correspond with a new tenancy | Corroborates accommodation spending; does not prove the relationship continued until the move |
| Six weeks later | Joint-account.pdf, page 5 | One party continues paying the mortgage | Shows continuing financial support; does not establish reconciliation |
Keep transactions in their source order and retain the original PDFs. Where an account has a missing statement period, record the gap before inferring that payments ceased. Reconcile apparent transfers across supplied accounts to avoid treating the same movement as new income.
For a large statement bundle, FinTrace takes over the monotonous conversion and review, returning hours to your legal work. The service supplies a searchable Excel ledger and a findings report with PDF filename and page references. Those outputs make relevant payments and their source evidence available together when you prepare the chronology.
Keep any later assessment of post-separation contributions distinct from recording the transactions. A payment’s occurrence and its legal treatment are separate questions.
Questions to Discuss With Your Lawyer
Use the first advice appointment to identify decisions that cannot wait and the records needed to support them. For a practitioner taking instructions, this means obtaining answers to the following questions.
- Is the relationship a marriage or de facto relationship, and where do the parties live?
- What separation date does each party assert, and what happened then?
- Are there safety concerns affecting communication, access to records or housing?
- Where will the children live immediately, and who is paying their expenses?
- Who occupies the home, and what mortgage or tenancy commitments continue?
- What income is available, and which debts or household payments fall due?
- Which financial records can the client lawfully access and preserve?
- Are existing orders, agreements or benefit assessments affecting the immediate arrangements?
Separation alone does not decide home occupation, account access or a final property division. Advise on the client’s rights using their ownership interests, contracts, existing orders and the available interim remedies. Identify whether urgent support or an order is needed before changing household arrangements.
Assign final property division to the property advice process, parenting arrangements to the parenting process and protection concerns to the appropriate safety response. Services Australia owns benefit calculations. Leave the appointment with an agreed evidence list, a recorded chronology and a named person responsible for each immediate decision.
