Vexatious Proceedings: Orders and Leave
Check whether a vexatious proceedings order restricts the next claim, what evidence supports an application and when leave is needed to proceed.

Vexatious proceedings orders restrict litigation within the terms of a court order and the applicable statutory scheme. Before the next filing, identify the person bound, the proposed proceeding and whether leave is required.
A lost financial claim alone does not establish the statutory basis for a restriction. This guide uses Queensland’s restriction procedure, with jurisdiction differences for New South Wales, Victoria and the Federal Court.
What a Vexatious Proceedings Order Restricts
A restriction order can control future litigation and affect existing proceedings. Its effect depends on the legislation and the relief actually ordered. Dismissal on the merits decides the particular claim. A restriction can require permission before another covered proceeding begins.
Under Queensland’s Vexatious Proceedings Act 2005, the Supreme Court can stay existing proceedings or prohibit new proceedings, including a particular type. Its statutory definition of instituting proceedings includes some preliminary steps and steps needed to start an appeal. Read the Queensland Act’s definitions and order provisions before treating a proposed application as outside the order.
The schemes have different reach. The NSW Supreme Court’s explanation describes orders affecting NSW litigation. Victoria uses limited, extended and general litigation restraint orders. These can address interlocutory applications, particular disputes or wider litigation. The Victorian court’s guide explains those categories.
The Federal Court has its own scheme under Part VAAA of the Federal Court of Australia Act 1976. A Federal Court restriction concerns proceedings in that Court. An order from one jurisdiction is not a nationwide prohibition on filing anywhere.
Check the Order Before the Next Step
Obtain the operative order and its subsequent variations before advising on a filing. A public list helps locate the record. The order and applicable legislation establish the restriction’s legal effect.
- Match the listed person to the client or opposing party. Record aliases and the capacity in which each party acts.
- Obtain the entered order, reasons and any later variation, discharge or leave order. Confirm the court and proceeding number.
- Describe the proposed step precisely. Identify the parties, relief and court, with a draft instrument where available.
- Compare that step with each operative restriction. Record any uncertainty about an existing proceeding, another entity or another jurisdiction separately.
A company sharing a director’s name or address needs its own identity analysis. Conversely, changing the named applicant does not answer an acting-in-concert provision. Queensland’s section 10 expressly addresses another person acting in concert with the restricted person.
If the problem concerns misuse of the present case, consider the distinct abuse of process route. That question does not by itself establish a statutory restriction on later litigation.
Assemble the Record for a Restriction Application
Establish the applicant’s entitlement and the statutory threshold before compiling the litigation history. In Queensland, section 5 identifies eligible applicants. An affected litigant or person with sufficient interest needs leave to apply. Section 6 addresses frequent vexatious litigation and specified acting-in-concert conduct.
The NSW threshold also addresses frequent institution or conduct of vexatious proceedings in Australia. Its authorised courts have different jurisdictional limits. The NSW Civil Trials Bench Book explains the statutory framework. Neither scheme supplies a universal count of lost cases that automatically justifies an order.
Fictional Disputed-Repayment History
Suppose a borrower repeatedly alleges that a lender failed to credit the same $40,000 repayment. Use a proceeding table to separate the allegations from the recorded outcomes.
| Matter | Parties and issue | Outcome to document | Record needed |
|---|---|---|---|
| First repayment claim | Borrower against lender over the $40,000 credit | Whether the court determined the credit issue | Pleading, reasons and entered order |
| Later claim | Same borrower and lender alleging the same loss | Whether the later court found relitigation or another defect | Later pleading and disposal reasons |
| Claim against an officer | Borrower alleges the officer caused that loss | Whether the claim raises a distinct duty or repeats decided allegations | Pleading, relevant findings and order |
| Costs application | Costs arising from a particular matter | Amount ordered and basis of the order | Costs order and any assessment |
A client’s description of the later case as harassment supplies an allegation to investigate. Identify the passage in the reasons supporting that characterisation. Keep a distinct claim distinct even if it also fails.
Avoid counting the same loss once for each pleading as though it were several financial losses. Separate claimed loss, adjudicated liability and costs. Attach source references so the court can follow the history without accepting a compressed narrative at face value.
Apply for Leave or Answer the Restriction Case
Seek leave for the identified proceeding through the scheme governing the restriction. Permission has to match the proposed litigation.
For Queensland leave applications, section 11 requires an affidavit covering earlier leave applications, other Australian proceedings and material facts, including adverse facts. Initial service is prohibited unless the court orders it. Section 13 requires notice and an opportunity to be heard before leave is granted. Leave can carry conditions.
The Queensland practice direction on leave applications requires the application to seek leave alone. It requires identification of the restriction, proposed proceeding, opposing parties, relief and grounds. Use the court’s application guidance and form links for the filing route.
In NSW, the court’s guidance specifies a summons and affidavit. It describes initial non-service, followed by court-directed service before permission is granted. Victoria directs leave applications to the court where the proceeding is to be brought. Do not transfer the Queensland form or service sequence into another court’s procedure.
When answering a restriction application, address the alleged history matter by matter. Identify omitted outcomes and distinguish separate claims. Explain why the proposed restriction exceeds the conduct proved, if that is the response. Queensland section 6 preserves an opportunity to be heard before the restriction is made.
Keep a challenge to the restriction separate from an application for permission to litigate. The civil appeal route depends on the decision and statutory limits. Queensland section 11(6), for example, bars an appeal from a decision disposing of the leave application.
Verify Permission, Conditions and the File Record
Check the entered leave order against the instrument you intend to file. A grant concerning one claim does not establish permission for every allegation or party.
Record the permitted proceeding number or proposed originating document, authorised parties and relief. List conditions separately, with the evidence showing compliance. Compare the final filed document with the version placed before the court.
If permission is refused, preserve the reasons and identify the statutory consequence before taking another step. In Queensland, proceedings instituted contrary to section 10 are permanently stayed. Filing first can therefore defeat the intended next step.
Finish the file note with a decision about the particular step: permitted, requires leave or remains restricted. Explain the supporting order and provisions. If the proposed claim changes materially, reassess whether the existing leave covers it and seek fresh permission where required. Once authority is clear, plan the permitted commercial litigation on that recorded basis.
