Account and Inquiry: Orders and Financial Evidence

Prepare an account and inquiry around the court’s defined question, with source-backed balances, identified objections and the resulting directions.

An account and inquiry establishes what a party must account for, examines the financial dealings within that scope and produces a balance or further directions. For a litigator, the first task is to define the right and question. The financial schedule then answers the order actually made.

This guide uses the NSW Supreme Court Equity General List as its procedural setting. A partnership account provides the fictional financial example. The relationship, pleaded relief and court directions determine which records belong in the account.

Identify the Right to an Account and the Question for Inquiry

Identify who owes the alleged duty, to whom it is owed and which dealings fall within it. Record each party’s capacity, the relevant agreement or trust instrument and the conduct said to engage that duty. An allegation of unexplained payments alone does not establish entitlement to every form of accounting relief.

Keep the legal basis beside the requested remedy. In Ancient Order of Foresters v Lifeplan, knowing assistance in fiduciary breaches supported an account of profits. The High Court examined both the causal connection and the benefit to be accounted for. That remedy does not follow automatically from a disputed partnership expense or an unexplained bank transfer.

Separate two questions in the instructions. What establishes the claimant’s right to an account? Once that right and its scope are settled, what financial work answers it? A preliminary dispute about the relationship or an earlier settlement can affect whether accounting proceeds and on what basis.

Select the appropriate process before commissioning the schedule. An executor’s passing of accounts has its own estate procedure. A private co-owner adjustment belongs to equitable accounting. A general ordered account must answer the particular court-defined question.

Frame and Read the Requested Order

Translate the requested relief into an order that identifies the accounting party and the dealings to examine. For the NSW procedural framework, use Uniform Civil Procedure Rules Part 46 alongside the applicable list directions. Distinguish an application for an account from the account delivered in compliance.

Prepare the application and supporting evidence around the asserted duty and need for relief. Put disputed preliminary issues before the court instead of embedding an assumed answer in the proposed financial exercise. Proposed directions can define the records to produce and the sequence for preparing and challenging the account.

Once the court makes its order, create a work instruction from the sealed wording.

  1. Identify the party and capacity in which the account must be given.
  2. Extract the period, property and transaction classes covered by the order.
  3. Record information and inspection rights, including who receives records and participates in the inquiry.
  4. Assign responsibility for preparation, required verification and filing or service.
  5. Diary the ordered deadlines and the procedure for objections and further directions.

The Equity General List practice note distinguishes service of main-case affidavits from filing affidavits supporting motions. It also requires practitioners to address timetables and the questions requiring expert assistance. Apply the actual account order to its own filing and verification requirements.

If the order leaves a consequential question unclear, identify the ambiguity and seek directions. Adding every transaction from every related entity can obscure the ordered account and increase work outside its scope.

Prepare the Account From Source Records

Build the opening position, receipts, payments and closing position within the ordered scope. Number each item and attach a source reference that survives sorting or a revised workbook. Keep an explanation for each allowance claimed by the accounting party.

Start with the relevant agreements and opening records, then connect bank entries to invoices, vouchers and other supporting documents. A whole fiduciary record in trust estate accounting can supply source material. Select the items needed for this order rather than importing the entire account without explanation.

Fictional Partnership Account

Assume an order requires a managing partner to account for cash received and spent during a defined trading period. The first schedule contains these fictional amounts.

ItemTreatment in the first scheduleAmountSource or issue
1Opening bank balance$10,000Opening statement
2Trading receipts$40,000Receipt ledger and bank credits
3Agreed trading expenses$25,000Invoices and bank debits
4Management allowance claimed$3,000Authority disputed
5Expense payment$2,000Bank debit, voucher missing
6Closing balance shown$20,000Items 1 + 2 − 3 − 4 − 5

A further $4,000 customer receipt appears in another supplied statement and was omitted from item 2. Add it to a proposed correction schedule with its source reference. Keeping both contested outgoings produces $24,000 after that correction. Disallowing the management allowance produces $27,000. Disallowing the unvouched expense as well produces $29,000.

These figures show alternative treatments of the account. A missing voucher leaves the purpose and entitlement to the expense unresolved. The bank debit establishes that money moved, while the party’s evidence must explain the payment and the basis for retaining it.

FinTrace removes hours of statement conversion and review from this preparation. Its searchable Excel ledger and findings report connect transactions to source PDF filenames and pages. The instructed party then reviews the account against their knowledge and supplies the verifying evidence required by the order. An analyst’s spreadsheet cannot supply that person’s sworn account of facts they must verify.

Test Charges, Errors and Allowances

Connect every objection to an account item or identified omission and state the treatment sought. For NSW proceedings, distinguish the Part 46 notice of charge or error from an informal comment on a workbook. Follow the court’s directions for its form, timing and service.

For the fictional account, an objection to item 4 identifies the $3,000 allowance and disputes its authority. The omitted receipt objection identifies the additional $4,000 and its statement page. The item 5 objection requests the voucher or other evidence explaining the $2,000 payment.

Preserve the account as delivered. Maintain a separate objection schedule with the accounting party’s response and any agreed correction. A corrected version needs a clear record of what changed and whether further verification or service is required.

A schedule that balances can still contain a disputed allowance. Avoid inserting an unexplained adjustment simply to reach the opponent’s proposed total. The court determines contested treatment through the inquiry and evidence.

Record the Determination and Complete Its Directions

Reconcile the resulting account to the court’s treatment of each disputed item. In the fictional example, a direction accepting the $4,000 receipt and rejecting both outgoings produces $29,000. Keep the reasons or order reference beside each adjustment so the result can be reproduced.

Read the operative orders before describing that figure as payable. The court might require a further inquiry or give a payment direction with separate terms. Costs also need their own treatment. A determination of the account and enforcement of a payment obligation are separate steps.

Close the instruction by confirming which account version is operative, what was filed and served and who must complete the next direction. The final schedule must reconcile to the determined balance, with every outstanding inquiry assigned to a responsible person and deadline.
