To become a barrister in Australia, follow the entry pathway for the state or territory where you intend to practise. An admitted lawyer must satisfy the applicable examination, course and reading requirements and obtain authority to practise as a barrister. Solicitor experience alone does not complete that process.
Choose the Bar and the Entry Route
Choose your intended practice location before booking an examination or arranging your departure from a firm. Australia has separate bar-entry pathways, with different entry conditions and reading arrangements.
Distinguish four stages in your transition plan. Professional admission establishes your status as an Australian lawyer. The bar’s entry pathway covers its examinations and training. Association membership is a separate question from the practising authority that permits your work.
Write down your admission jurisdiction, current certificate and conditions, intended practice location and any previous bar practice. Add overseas qualifications or earlier reading experience if you seek recognition. These facts determine whether you follow first-time entry or need a returning-practitioner, interstate or exemption decision.
The NSW, Victorian and Queensland examples below show why a national timetable would be misleading. For another jurisdiction, start with its own association through the Law Council’s constituent-body directory. Obtain that jurisdiction’s entry requirements before using another bar’s exam or course as part of your application.
Check Admission and Your Existing Authority
Check admission and practising authority separately at each entry stage. A person eligible to sit an examination may still lack the admission or certificate needed to begin practice.
The NSW Bar examination guidance allows candidates to sit before admission. Admission is needed for the certificate and commencement of the reading programme. Queensland instead requires applicants to be Australian lawyers when applying for its pre-course examination and course.
Victorian membership applicants must be Australian lawyers or reasonably expect to become Australian lawyers before signing the Bar Roll. Use the Victorian Bar’s regulations to establish your eligibility at the proposed stage.
For an admitted solicitor, gather evidence of admission and the current certificate, including any conditions. Check whether an existing restriction, fitness disclosure or unresolved regulatory matter needs a separate decision. Record the regulator’s answer before relying on an assumed exemption.
First-time entry differs from recognising earlier bar practice. In NSW, the exemption policy provides a written application process for specified examination, course or reading waivers. It sits alongside a separate returning-to-the-bar policy. Supply the experience and supporting material relevant to the particular waiver requested.
Interstate practice and overseas recognition also need their own assessment. Identify whether you seek to practise under an existing Australian authority, obtain a new local certificate or have earlier qualifications recognised. Keep the written decision and its conditions with your application file.
Complete the Examination and Course Requirements
Complete the local entry assessments and secure a course place before treating the training stage as settled. A passing result and a confirmed course offer are different records.
| Bar | Examination checkpoint | Course checkpoint |
|---|---|---|
| NSW | Obtain at least 75% in the NSW Bar Examination | Receive and accept a Bar Practice Course place within the result’s permitted currency |
| Victoria | Pass all three exam components, with at least 75% in each | Obtain an allocated Readers’ Course place and complete its required programmes and assessments |
| Queensland | Pass each of the three pre-course examinations at 65% | Obtain a course place and satisfactorily complete the six-week Bar Practice Course |
The NSW examination policy requires the qualifying result within 15 months before the course starts. A failed candidate may sit when the examination is next conducted. Its moderation and special-consideration provisions have separate criteria.
NSW Bar Practice Course registration is by invitation after a pass. Places are limited, so a preferred course is not guaranteed. Keep the offer and acceptance before arranging leave or ending employment.
The Victorian Bar’s 2026 examination guide distinguishes component passes from course allocation. It permits component credit within two years or four consecutive sittings, whichever is longer. The guide explains how an unsuccessful component can be resat within that period.
Under the Victorian Membership, Examination and Reading Regulations, the course includes preliminary work, an intensive and a development programme. An accepted applicant seeking deferral for exceptional, unforeseen circumstances must apply in writing with supporting evidence. Permission is discretionary.
Queensland’s eligibility and course guidance requires admission evidence and, for practising solicitors, the current certificate. Attendance and satisfactory participation are required throughout the full-time course.
Its Information for Applicants governs result currency and resits. All parts must be passed within three successive examination periods, including missed sittings. Failure to complete within that period brings a further period of ineligibility. Course deferral also affects result currency, so seek a written decision before changing your plan.
Use this sequence for your selected bar:
- Submit the application with eligibility evidence and required declarations. Retain confirmation that it is accepted.
- Prepare from the official syllabus and instructions for your sitting. Complete any required technical preparation.
- Retain the official examination result. Resolve any recognition or special-consideration request through the named decision-maker.
- Accept a confirmed course place and complete its preparation requirements.
- Complete the course assessments and obtain the required completion evidence. Record any outstanding component before applying for authority that depends on it.
Use the official sitting and course pages for application windows. A deferred course, incomplete assessment or pending waiver changes the next permitted step, even if you have already paid a fee.
Arrange Reading and Check Permitted Work
Arrange an eligible tutor or mentor and read your certificate conditions before accepting work. Course completion does not by itself remove reading restrictions.
NSW’s reading programme starts with issue of the reader’s certificate and lasts at least 12 months. It includes a tutor and verified civil and criminal reading. Arrange the required record and sign-off as you complete each activity.
The NSW reader conditions prohibit practice during the Bar Practice Course. After course completion, appearances remain restricted until the relevant reading requirements are satisfied. A reader may need an unrestricted leader or the tutor’s prior written approval for each appearance.
NSW tutors must meet the Bar Council’s tutor policy. Choose from the approved list or obtain the required approval. A willing colleague is insufficient without eligibility.
Victoria’s ordinary reading period is nine months from commencement of the course intensive, unless dispensation sets another period. It involves reading in an eligible mentor’s chambers and a senior mentor arrangement. Keep the prescribed completion records and obtain the required certification.
Queensland readership begins with the first private Bar certificate and continues for at least 12 months, subject to completing its requirements. It requires a senior mentor who is King’s or Senior Counsel and a junior mentor with at least five years at the private Bar.
Consider a hypothetical financial-evidence brief sent to a new reader. The instructing solicitor supplies bank PDFs, a transaction schedule and a report identifying transfers between related accounts. The reader checks that the schedule’s source references locate the relevant statement pages and that the totals support the issue being argued.
One outgoing transfer has no matching receipt in the supplied destination statements. The reader asks the solicitor whether the destination records are complete and what evidence establishes the recipient. An unmatched entry alone does not establish where the money ultimately went.
FinTrace supplies an Excel ledger and findings report with source PDF filename and page references. Those references give the reader direct access to the statement evidence while considering the legal question. The reader obtains any supervision or written approval required for the proposed advice or appearance before proceeding.
Move Existing Matters and Set Up Bar Practice
Arrange lawful cover for existing solicitor matters before changing your practising authority. Build the handover around live responsibilities and deadlines.
For each matter, identify the practitioner who will take responsibility, any client instruction or consent needed and the next court or contractual deadline. Confirm the transfer of the file and the new practitioner’s acceptance. Resolve employment obligations and client communications through the firm’s transition process.
Queensland’s certificate application requirements provide a concrete transition example. They require admission and course evidence, fitness or good-standing records and relevant disclosures. A former solicitor must supply confirmation from the law society or interstate equivalent that the solicitor’s certificate has been cancelled.
For private practice, the Queensland application also requires evidence of paid professional indemnity insurance with an approved insurer. Check the required coverage period against the application, including the time before your intended first brief. Coordinate cancellation and the new grant so another authorised practitioner covers every matter while you cannot act.
Keep an administration record with the responsible person, supporting document and outcome for each task. Include the certificate application, insurance, mentor appointments and matter handover. Track chambers, bookkeeping and business arrangements separately: arranging premises or receiving a course certificate does not grant permission to practise.
Verify Authority Before Accepting Briefs
Accept a brief only when the issuing authority has granted the required certificate and the work fits its conditions. Read the certificate itself, including its effective period and any reader or other restrictions.
Confirm that insurance is effective for the proposed work. Check any required supervision and retain the written approval where the conditions require it. Queensland’s application process expressly distinguishes approval and payment from confirmation that the certificate has issued.
| Unresolved issue | Responsible body | Record needed to progress |
|---|---|---|
| Missing course evidence | The bar’s course or education team | Completion certificate or an identified outstanding assessment and completion plan |
| Fitness disclosure awaiting decision | The issuing authority or its designated decision-maker | Full disclosure, supporting documents and the written determination |
| Unavailable tutor or mentor | The bar’s reading or education team | Proposed eligible replacement and any required approval |
| Interstate recognition uncertain | The intended jurisdiction’s bar or certificate regulator | Existing authority, practice history and written recognition or exemption outcome |
While a decision is pending, keep existing matters with a practitioner whose authority permits the work. Tell the instructing solicitor promptly if you cannot accept the proposed brief and arrange cover for any deadline. Do not represent a pending application as a granted certificate.
Record completion of reading through the required forms and certification. Obtain confirmation of any later condition removal from the issuing authority. The passage of a reading period alone does not establish that you can accept unrestricted work.
